I am a Filipina seperated with 3 kids. My partner is Canadian from Toronto. He would like to sponsor me via conjugal partnership since we were denied trv twice maybe because I am a nurse. We have been together for more than 1 year he is supporting me I am not working since this is what he wants. He visited here in the Philippines Twice and we lived together the first visit was for 3 weeks the second visit was for 5 weeks. We really love each other he even proposed to me already but the thing is we do not have divorce here in the Philippines. We really want to be together and start a family but we cannot due to immigration barriers and my situation. When we applied for trv i stated there that I am married since I'm not legally separated and like what I said there is no divorce here. And he invited me as a family friend to protect me because here in the Philippines I am still married. We have all the proofs to prove that our relationship is genuine, phone cards, telephone bills, text messages, skype, western union receipts, plane tickets, tons of pictures, we even have a scrap book that we made for us to remember everything, I met his dad and his Filipina step mom last time he visited and we had dinner together with my mom and my step dad. We talk all the time I call him to wake him up and talk to him till he goes to work, I call him during his breaks thru magic jack,and we even watch each other sleep on skype my body clock is even following canadian time. He's even working 2 jobs to provide for me and for everything that we need. Will it be faster to apply it in Toronto or in Manila? Do u think that we have enough grounds for conjugal partnership? Thanks!!! Your help will really be appreciated. We really miss and love each other that we cry almost every night out of frustration because we cannot be together. :( :( :( :(

You will have a good chance to get accepted through conjugal class, since you can't get divorced. You first have to prove that you have been in a conjugal relationship for a year - a conjugal relationship is a relationship like a marriage, with all the hallmarks of a marriage, escept you can't get married (or live together). So the whole time you have been in a relationship will not count as the conjugal part of the relationship. For example, when two people first meet and are just dating or chatting on the internet, and haven't yet made a committment to one anther, this is not a conjugal relationship. So you have to decide when the relationship first became 'serious', and then have a year together after that.
When was the first time he sent you money? If you can prove through the Western Union receipts that he has been supporting you for a year, that would go a long way to proving your finances are joined the way a married couple's would be - one of the ways the visa officer uses to decide if the relationship is sufficiently 'marriage-like'. You would also have to show that he has a good relationship with your children, and that you have a good relationship with his children, if any - how the couple treat any children brought into the relationship is another test the visa officer uses to determine if the relationship is real.

Once the application is filled out, it is sent to the Mississauga, Ontario processing center. They will decide if he qualifies to sponsor you. If he does, they then send it to the visa office in Manila.
You can only apply 'inland' (through Vegreville, not Toronto) if you are actually in Canada.

As canadianwoman already mentioned you should have a strong case for a CP application. I also applied and was approved in this category though my circumstances differ from yours. Don't be shy about posting new threads and contacting other members. There is a great deal of knowledge and support to be found here as you put your application together.

You will want to read sections 5.25 through 5.36 at least. The key to establishing a marriage-like relationship is providing evidence of a high degree of interdependency in various aspects of your lives as you will soon see from the OP2 manual. The manual will also give you examples of the types of evidence to provide.

another question I am not taking any of my kids yet because they are still studying here and I would like to get adjusted and establish there first if ever I get there. And then my kids will just follow. I can do that as non accompanying dependents right?

Yes. You could also do it as accompanying dependents - they could just come with you and 'land', then go back home. Or they could get their PRs at the same time as you, but fly to Canada later.
It depends how long you want them to stay in the Philippines before they come to Canada. If you want them to stay a couple of years, then have them as non-accompanying dependents. If you want them to come to Canada a few months after you, have them as accompanying dependents.

Yes if the "legal" marriage has broken down and the "legally" married couple are considered separated and have been so for some time (1 year i think)... it's a perfect example of where a conjugal relationship is valid (especially if the married couple are prohibited from divorce by law or religious practice)

follow up question. sorry I've been trying to research but I can't seem to understand at all. If my children wont accompany me do they still need to undergo through medical? And if so, do I need to submit it together with the application. Because it will really be difficult for me to have them go through medical since they are with my ex-husband. Thanks again ;D

Even if they are non-accompanying it is in your best interests to have the medicals done. This preserves your right to sponsor them in the event of some unthinkable happening (what if something happens to their father?), and it will make your processing go a lot smoother. There are cases on here of parents with children that have not been examined that CIC is insisting that they present a medical for them, regardless of circumstances.

Difficult =/= impossible.

Yes....you must have your dependent children give a medical exam, otherwise they may make you sign a form stating that you will not be able to sponsor them in the future.
