Dears:
I had landed to Canada 2010 as skilled worker with my family, I stayed there for 40 days, we had have our PR cards and social numbers that time, we left after that short stay ( 40 days) and we had never come back to Canada, and I have been working and my family with me in gulf area since 2010, we came to the UK in 2017 in a visit and for some circumstances in gulf area we are seeking asylum, Home office rejected our case saying that our status still valid despite the expiry date on the cards is 2015, so the cards are invalid.

We are out of Canada since 2010 until now without a single re-entry and we don't meet the residency obligation requirements as per the CIC website.

Do we still have our status valid that allow for us to be provided PR TD and renew our PR cards?

please advise.
 
Others I am sure will comment as well but you have failed the residency obligation by years so whilst you are still PRs given only PR cards expire whereas PR status does not expire it can only be renounced or revoked.

At this time your only option would be to come back to Canada via the US land border and hope you do not get reported. This given you cannot apply for a PRTD now as that for sure would start the PR revoke process and you need as you probably know either a valid PR card or PRTD to board a plane for Canada. If you are successful entering through the land border then you would need to stay for 2 years without leaving or applying to renew your PR cards. Of course this option assumes you all have US visas.
 
Why did you not go back to Canada after getting PR, is the first question. Second question is if you renewed your PR would you go back to Canada. If not, it seems you tried to get the PR for other reasons than moving to Canada. You can revoke your PR, but the UK rightly refused your application for asylum in my opinion.

If you already tried claiming asylum you will probably never get a visa to travel to USA to enter Canada via land border.

And if you apply for a PR Travel Document to try and get to Canada, you have been in violation of RO for so long it will probably be refused.

So honestly I doubt you can ever return to Canada again unless you renounced your PR status or had it revoked, and then qualified for PR again under a current economic immigration stream.

It's probably been noted by IRCC as well, that you have attempted to claim asylum in the UK. I'd suspect even if you did manage to get a US visa, you would be pulled straight into secondary.

I don't see how this is confusing at all.
Canada granted you PR status to come to Canada to live and work, and contribute to Canadian society. Despite being given the opportunity, you decided not to use the benefits accorded to you and failed to meet the very easy to attain and generous residency obligation in order to safeguard your status.

You still have PR status, but any interaction with IRCC will likely ultimately lead to the revocation of that status. The PR card is like a passport, a travel document. It expires, but you are still a Canadian PR.

I don't know your situation, but it seems like you are residency shopping and have no intention of settling in Canada so it's probably best to renounce your PR status and go from there. If you do decide to return to Canada, I hope that you actually follow through and settle this time and don't just get the papers to have the option.

Your asylum claim is just further evidence in the eyes of Canada that you don't actually intend to return to Canada.
