Conflict between job title on contract and actual tasks. Advise plz!

Hi everyone,

Can you guys give me advice on my eligibility for PR application.

Im working at a recruiting agency in Ottawa, its almost one year now and im soon gonna to start my PR application. But what worries me is the inconsistence between my job title on my contract and my actual job. My contract says im an " independent marketing representative"; fyi independent just means i have to file tax on my own. Everyone in the company such as the recruiters and sales has the same job title. However, my actual tasks have nothing to do w sales or marketing. Im more like an executive assistant/ account manager (NOC 1222/ 0601). I work directly with the CEO of the company. Below is summary of some of my taskss:

-Conduct research, compile data, and prepare documents/ paper for the executive
-Contact clients on behalfs of the executive, discuss issues and assess and recommend various courses of action with the exec.
-design and maintain database
- coordinate with staffs at all levels
- Managing a portfolio of accounts
-work closely with recruiters and responsible for all client communications, conflict resolution, and compliance on client deliverables and revenue

I hope to have my letter of employment to state all my actual work, but im afraid my title on contract might throw me off since marketing representative is not considered as skilled work.

I need your advise. Thanks alot!!

Several things to consider... Before providing further detail I think the two issues that need to be addressed are: -

1) Are you on a closed or open work permit?
2) If you file your taxes yourself, chances are CEC will see you as being self employed. Those who are self employed cannot apply under CEC.

If you're paying your own taxes, it is likely that you're a self-employed contractor. Unfortunately, as per jsm0085, you can't apply under the CEC if you're self-employed.

Jsm0085: Im under open work permit.

I talked to my employer and they said they will give my a summary of how much i make a year, written on the letter of employment with the company's letter head so i'll be able to send it to the CRA for my tax purpose. Will the letter make any differences?

I would suggest that you become more familiar with the basics of the CEC application -
http://www.cic.gc.ca/english/information/applications/cec.asp

and see the document checklist in particular -
http://www.cic.gc.ca/english/pdf/kits/forms/IMM5610E.pdf

There are detailed requirements, including a letter of reference from your "employer" that must contain specific information; you must also submit tax documents, so if you are self-employed, there would be no hiding the fact.

Basically if you self employed, it doesn't count towards CEC experience. Usually when someone received a T4A, instead of a T4, they are self employed. However, I imagine it would depend on whether you have an "employment contract", what it states etc.

In my head there is a big difference betweens someone who is self-employed and works for several clients, and someone who works exclusively for one client. My personal recommendation would be to see a good immigration lawyer - they would be able to give you a pretty straightforward answer as to whether or not you could proceed - taking a look at the job you were doing and any employment contract you have...

Yeah in my head, self-employment does not involve coming to the office 40 hours a week.
