Hi

If one is issued with conditional spousal PR (2 years relationship condition) and that is not met due to a relationship breakdown how does the condition come into effect and is there any way of still retaining the PR status.....

This rule is too new and we really haven't seen anyone go through the process in the event of a relationship breakdown. So I think any information provided now would just be a guess.

According to the rules, if the relationship breaks down during the two year period, then the applicant loses their PR status. If they want PR status back, they would have to qualify and apply through one of the other immigration classes.
 
You can apply for an exemption from the 2 year rule if you were abused or abandoned by your spouse.
 
How can I report / prove a non-physical abusive behavior....what does the Canadian law have for reporting / covering the applicant for such instances....

I have no idea how you would prove it. You are usually home alone with your spouse so there are no witnesses. I suppose you could discretely record or videotape their behaviour.

As said, it's a new rule so I have no idea how strict they will be when it comes to enforcing it. They might use it to go after people who have left their spouse a very short time after getting PR and or where the sponsor has complained or they might potentially go after everybody who has split up, regardless. I am sure people will be able to appeal though but without being able to prove abuse, you might have a difficult time.

I know folks will really dislike this statement, but oh well ....

Anyone that is ALREADY asking how to get around the conditional PR has probably only landed within the last few months. This person is already trying to prove an abusive relationship, however, is willing to continue being in this abusive relationship to see how others fair out first.

This so smacks of MOC and the now new PR wishes to figure out where the nearest loophole is to slip through.
