I wonder why did CIC gave me condition 51 "must live with her sponsor for 2 years" if we were living together prior the application for 2.4 years. Can I contact CIC for removing this condition?

You need to have been officially common-law for 2 years before applying. First year you lived together, you were not common-law.

So that means 1 year qualifying for common-law, then 2 years as common-law, so 3 years in total living together to avoid Condition 51.

Based on what you wrote, as Rob mentioned, you were officially common law for 1.4 years. Not 2.4 years, thus fall under the conditional 51 clause.

oh wow I didn`t know that first year is not considered common-law...I arrived in Canada 4 November 2011 and we lived together since until March 2013 when we applied for sponsorship. I thought all this time as we shared household is considered common law and was over 2 years.

The day after 1 year of living together becomes your "married date" if you will. This date would be the equivalent of getting married on that day. 2 years after this official date when CIC received the application would be the time the conditional clause would not apply. Anytime during the 1st 12 months together, you were considered to be "dating" each other.

thank you very much for the explanation! Anyway, if my spouse doesn`t look at my COPR, he will never find out that I have 2 year condition, right? I just showed him my immigrant visa in my passport and not the confirmation of permanent residence.

I will be landing soon when we come back from Mexico or Cuba vacation in September, I hope I can "land" and he won`t be close with me. The reason why I don`t want him to know is IN CASE of our fights which happen in almost every marriage I don`t want him to use this and threaten me that he may revoke my PR (when I had just temporary visa he used twice frighten me that he will send me back when we fought and it felt horrible). I don`t mind the condition because i love my husband and not going to divorce ever, I just don`t want him to know about it.

Just a word of advice - in healthy / normal relationships a person would never threaten to send you home. So what you're experiencing isn't normal and doesn't happen in every relationship. Are you sure you want to be with this person?

When my husband landed last Saturday, I was right there as they were asking him the question about condition 51. Unless your husband is standing in a different area when you're landing (which would seem weird to CBSA officers I think, if you are travelling together) he will most likely find out about the condition, as they ask you if you understand it and agree to it before they let you in.

wow good to know!! then we would definitely be together.....I just don`t know how exactly landing process goes.

Well I have another option...I can go by car to the American border here near Vancouver and land myself and then we would go to Cuba and there in Havana I could get a travel document PRTD (I just need some kind of proof that i lived in Canada 720 days) for returning to Canada as my PR card won`t arrive yet. I think this might work...

thank you for your advice and i understand that too...... he loves me and does sooooo much for my family over there not just for me, brings my mom to me for a visit to Canada every 4 months etc, I really want to be with him but he used to threaten me before 2 times with this "I will buy you ticket and send back to Ukraine" when we argued and I don`t want to hear something like this ever if he finds out about this 2 year condition I have.

But...doesn't he have a right to know?

After all...he is 50% of this application process.

No kidding. It's tough enough having a long distance relationship, then going through a stressful immigration process. Better be sure that honesty and respect are equally important as the love you supposedly share.

When I landed the officer called my boyfriend to the counter and explained us condition 51 at the same time. So your partner will know about the condition if you enter Canada together on your "landing day"

ok...then I will "forget" my COPR when going to Mexico and use for entering Canada my study permit and TRV (valid until November) and then set an appointment with CIC office in Edmonton and "land" there myself...

I assume your TRV is multiple-entry?
