Hey Guys,

Currently filling out my documents for Common Law Visa.

Im currently in Canada on a Closed Work Permit, allowing me to only work for the current employer.

I would like to submit a request for an Open Work Permit in case my employment conditions change.

I am trying to make sense of what forms I need to submit.

Would anyone have a simple explanation?

I've downloaded:
- Form 5556 (Checklist - Worker In Canada Applicant)
- Form 5710 (Application To Change Conditions)

- Are there additional forms to complete?
- What is the additional cost?
- Is this done online or are the forms submitted with the Common Law application?

Those are the forms for submitting an OWP

If you are in Canada, and are applying for spousal sponsorship -PR under common law then you should submit the OWP application together with your PR application, in 1 envelop.

cost for the owp is 100+155= 255

you should note that you have to submit it together with your PR sponsorship application, on paper and not online

Open work permits for spouses or common-law partners in Canada
If you’re applying under the Spouse or Common-Law Partner in-Canada
class, you may qualify for an open work permit while your application for
permanent residence is being processed. You can submit your
application for an open work permit together with your application for
permanent residence, or after you apply.
To include your open work permit application with your application for
permanent residence, use the Application to Change Conditions or
Extend Your Stay in Canada as a Worker. After filling this out, place the
open work permit application right underneath the sponsorship
checklist.

If you’re applying under the Spouse or Common-Law Partner in
Canada class and the person you’re sponsoring is also applying for
an open work permit, after the checklist, place:
the work permit application form and documents (if applicable)
and
a separate fee payment receipt for the cost of the work permit
application
3. The order of documents should be as follows:
checklist;
open work permit application (and supporting documents), if
applicable;
any barcode pages;
supporting documents, in the order they are listed on the
checklist.

In relation to the Work Permit:

FORM: IMMI 5710:

> TOP SECTION: Q3 - Do I select "Apply for a new work permit for the first time or with a new employer"

... even though I do not intend to leave my current employer yet? This is more to allow me to have future options of open work....


> SECTION - DETAILS OF INTENDED WORK: Q2-7 - Do I leave this section ALL blank as a I don't have a prospective employer? I have a current employer...


> SECTION - EMPLOYMENT: Q1 - As I am currently employed, what to I put into the "TO" Date Box?

Do we need to add duplicates of the same documents for the Work Permit, even though they go in the same parcel?

... even though I do not intend to leave my current employer yet? This is more to allow me to have future options of open work....

I do not think it would matter if you put that. It does not necessarily mean you have to leave the current employer

> SECTION - DETAILS OF INTENDED WORK: Q2-7 - Do I leave this section ALL blank as a I don't have a prospective employer? I have a current employer... Again it would not matter....your current job might not necessarily be the intended work, but if it is then simply put in the details

You would write in Current/Present ( by hand) after printing

Do we need to add duplicates of the same documents for the Work Permit, even though they go in the same parcel?
So have put in a copy of marriage certificate and copy or required IDs as per the work permit checklist because although they are sent together in one package, these are 2 separate applications processed separately. Some have not.... I remember seeing 1 case where they were asked for proof of marriage for the OWP although they had submitted it with the PR. You might want to look into it
