Hi...just seeking advice.. I'm in commonlaw relationship we move in together in august 2013...and now we have a baby...the problem is..I filed my divorce in aug 2013 on my 1st husband and divorce still ongoing..can my common law husband sponsor me now?.. He is a canadian...Cause right now I'm in a skilled working visa..do u think CIC will not refuse my paper?... Thanks

You are allowed to claim common-law when you are still technically married to someone else. CIC will accept this.

He can sponsor you as common-law after 12 months of living together. So you have to wait until August 2014. But you can already start collecting evidence (joint lease, joint bank account, joint life insurance, at least 2 statutory declarations from friends/family etc) http://www.cic.gc.ca/english/helpcentre/answer.asp?q=347&t=14

As mentioned above, I forgot to look at when you started living together. You started living together Aug 2013. So you can be sponsored as common-law as of Aug 2014, after 12 months of living together.

Also as above mentioned, start collecting as much evidence of your common-law relationship as much as possible. CIC tends to look at common-law application much closer than married couples. Common-law couples have a more burden of proof to provide over married couples.
