Common law partner visa after working holiday visa

Hi guys,

My girlfriend and me are both with working holiday visas. I am getting into public school very soon (with a student permit) and we want to apply for common law visa for her, I wonder if she will get implied status until decision is made in her visa and what kind of status she could keep? Would she be able to work while that?

You don't apply for a "common-law visa"; rather, if she counts as your common-law partner (at least one year of continuous cohabitation) she can apply for a spousal open work permit. If you get the study permit and she applies before her IEC expires she would have implied status. Otherwise she will need to apply to change her status to visitor first.

Thanks for the answer primeprime, do you know if this is the form she would has to fill out? And if she would keep while implied status her open work permit as before?

• Change Conditions, Extend my Stay or Remain in Canada as a Worker [IMM 5710]

• Copy of student's study permit

• Copy of spouse/partner's study/work permit, visitor record or visa (if applicable)
