'cohabitation' in a conditional PR

I will be getting a conditional PR due to the new laws.

This means we must 'cohabit' for 2 years from when the PR comes into action.

Does anyone know what they mean by 'cohabit' exactly?

Live together. That is the minimum requirement. Usually cohabit means living together with an intimate relationship.

yes i know that much, what I mean is.... what if one of us gets a job in a place where say you have to stay away for a few days a week I know my job does that, what if i come back to england for 3 weeks over xmas, what if my husband has to be away in the US for a month which his work does and what if i have to be away at a different location a few days every week on night shifts or oncall? Can I just not do this?

I would imagine that as long as both your permanent addresses are the same, it is fine... as long as the travel is not too excessive. What CIC would consider "too excessive" I don't know. But if much of the travel can be justified (like your Canadian employer is sending you on a business trip, etc), then I imagine that is fine. Hopefully the other more experienced people on this forum have a better answer for you.

Right now there is no right answer, as we haven't seen any cases yet of these conditional rules put to the test.

CIC says as long as the time spend apart is for school, work or family reasons, and the time is temporary and short, then it won't break cohabitation (same rules as for establishing a common-law relationship). But of course "temporary and short" are open to interpretation.

However my opinion is that CIC won't care about the majority of cases, or even know about partners short travels here and there. They will only be going after cases where they have received a specific complaint (separation and sponsor reports the PR to remove their PR status), or where there is obvious evidence (such as partners changing address info with CRA for taxes, or the PR returning through immigration after a very long trip abroad).

5.35. What is cohabitation?

“Cohabitation” means “living together.” Two people who are cohabiting have combined their affairs
and set up their household together in one dwelling. To be considered common-law partners, they
must have cohabited for at least one year. This is the standard definition used across the federal
government. It means continuous cohabitation for one year, not intermittent cohabitation
adding up to one year. The continuous nature of the cohabitation is a universal understanding
based on case law.

While cohabitation means living together continuously, from time to time, one or the other partner
may have left the home for work or business travel, family obligations, and so on. The separation
must be temporary and short.

The following is a list of indicators about the nature of the household that constitute evidence
that a couple in a conjugal relationship is cohabiting:

• Joint bank accounts and/or credit cards;
• Joint ownership of residential property;
• Joint residential leases;
• Joint rental receipts;
• Joint utilities accounts (electricity, gas, telephone);
• Joint management of household expenditures;
• Evidence of joint purchases, especially for household items;
• Correspondence addressed to either or both parties at the same address;
• Important documents of both parties show the same address, e.g., identification documents, driver's licenses, insurance polices, etc.;
• Shared responsibility for household management, household chores, etc.;
• Evidence of children of one or both partners residing with the couple;
• Telephone calls.

These elements may be present in varying degrees and not all are necessary to prove
cohabitation. This list is not exhaustive; other evidence may be taken into consideration.
