Hi All,

I am in a bit difficult situation, if someone please please can help me sort this out.

Me and my wife both are permanent residence of Canada since 24th September 2010.

But due to some family issues we are staying in UK, since 22 Februare 2011.

We are expecting our first baby here in UK in May, and then after we all want to go back to canada.

I tried to get the information from the CIC UK about the process for getting PR for my due baby (of course it can be done only after the birth).

But they advice me that I cant take my baby with me as he/she will have british passport.

My baby will be able to be in Canada for only 6 months without any visa as he/she will have british passport, but we really want to settle back in canada,

what should i do to get PR for my baby after the birth?

we want to come back to canada in month of september 2013.

Please please please help on this as i really dont know what to do.

well you can have her come with you as a visitor and then extend her stay with CIC while you get her PR application underway.

the issue with that would be that they will see 2 canadian PRs and a 'visiting' baby, so I'm not sure they would believe that the baby is truly visiting and possibly refuse entry. it is possible to sponsor the child via the outland route. but this will delay your settling in Canada date.

With a British passport your child will be allowed in Canada for 6 months. At the Canadian airport you should request the CBSA for granting an extended period to the baby because you are going to submit the sponsorship application at the earliest opportunity. Perhaps the officer may grant your request. Otherwise, cross the border to USA by your car on the last week of allowed period and re-enter. Good luck!!!

my only caution with the second part of that suggestion (traveling to US) is that they can always refuse re-entry, and that power lies with the border guard you run into.

Hi,

So is there any other way on which i can apply for long term visa for my baby?

Hi All,

Thanks very much for your help.

I contacted the CIC UK, and they adviced me to apply for TRP (temporary residence permit).

I need to submit completed TRV form stating on top of that i m applying for TRP.

Thanks a lot you all for help.

Tough situation. Don't forget to make sure you consider what (if any) health care coverage your baby has. Not worth taking chances.

Im in somewhat a similar situation :/ and still have no idea what to do.
There's no CIC office here in Portugal (where we're from) .
It's been tough on deciding whether or not to go before our new baby is born (june 2013) or after because of the health coverage both for me , my 2 year old and my new baby. We do however have to go to Canada before Sep 2013, date which our 1095 absent days are up.
