Hi there..

My husband is Canadian and I am in processing on Family sponsorship immigrate on last year.

I have been in Canada for 3 years and applied Tax return 3 times for myself..
It is my first time to apply tax return me and my husband together .. we don't have child yet.

When I try to tax return on simple tax, they asked me

"Check here if you can't claim the amount for partner on line 303"
"
You should check this box if:

  • you didn't support your partner, or
  • you'll claim deductible alimony.
If your partner is a non-resident, review paragraph 1.92. "


Do you think should I do not check this box or not...
I think I am not a non-resident ( have 2 years open work permit) and my income is under $11000.. (employment income $10000) also he will not claim deductible alimony cause we live together.

So... is it right we dont check that box under both of us?

Even if you are married, you still file ITR separately, it is not combined.

These are the only ones that you can transfer:

You may be able to claim all or part of the following amounts your spouse or common-law partner qualifies for, if he or she did not need the whole amount to reduce his or her federal tax to zero:
  • the age amount (line 301) if your spouse or common-law partner was 65 years of age or older;
  • the pension income amount (line 314);
  • the disability amount for self (line 316); and
  • the tuition amount (line 323) for 2017 that your spouse or common-law partner designates to you. The maximum amount that your spouse or common-law partner can transfer is $5,000 minus the amounts that he or she uses even if there is still an unused part; and
  • the Canada caregiver amount for infirm children under 18 years of age (line 367).
