CHC, Islamabad Spouse Sponsorship Timeline 2011 -2012

Dear forum members I have been away from the forum because I got busy as I recently delivered baby boy I have a question I am planning to visit Pakistan I am on PR. I wanna know how long I can stay there? do you members have any knowledge about it or did you discuss it with your lawyers/consultants? plz waiting for responses anxiously.

Hi sis! Congrats on your new born baby!
You can stay outside of Canada for 3 years with PR no later than 3 years, but the only disadvantage you will have is, the more you stay outside the more you gotta wait to apply for your citizenship. Say if you lived in Canada for a year and your going to live in Pak for 1 year then the wait to apply for citizenship for you will be 4 years not 3 years. My uncle has gone to Dubai since August 2011 and he is PR

I don't suggest you staying more than 3 months. As my lawyer said those who stay for a longer period in backhome with spouses cic doesn't bother speeding up their application. They kinda think you and your spouse are not willing to stay in Canada so why bother.

the residency requirment to maintain your PR status is "minimum of two years in a five years time frame since you first landed in Canada as PR

You can leave Canada (and if you are going to collect Materity EI benefits as well), you may like to provide a proof of your EI Maternity benefits plus a letter from the employer that upon end of your Maternity leave you will join them back



In addition you need to calculate that if you stay out of Canada as a PR for lets say one year to go back home, if that abscense will conflict with minimum residency requirment of two years as described above


At the end you may like to write a letter to CHC-ISB that by staying with your husband in Pakistan you will still be able to maintain your PR status since you already meet 2 out of 5 years requirment and have a job to go back to so they dont question your ties with Canada otherwise they have just rejected the entire application on this excuse alone in the past

so according to u guys i can stay in pakistan for three months and it will not have bad impact on my husband's sponsorship case?

I have a question for everyone.

My cousin filed his application on October,2011 and got AOR on Dec,2011. Ever since then his wife didn't receive anything until now. His wife's medical expired Sep, 2012. However his ecase went "in process" since February 4 2013. So he wants me to ask senior members on his behalf. Should they expect passport request or re-medical.

According to him ecas turns into "in process" when u actually expect ppr so he is confused.

Please share ur exprience!!

updated forms/documents request
remedical plus updated forms/docs
remedical
remedical plus PPR

I have been an avid follower of this thread and believe me this has really encouraged me through these trying time making me feel that i m not alone ....... ;D, my time line goes as following ...Mine is a Husband case though my wife has been living with me for a year now as we just had a baby boy our first child ;D 27 December 2012

recieved remed request 06 Sept 2012
Remedical recieved 23 Sept 2012
rest still waiting ....


Now i have few questions ...
My Police clearance certificate had expired with the med but they only asked for re med.....is it normal??? had anybody experienced anything of this sort or should I send another PCC???
Now My status on e-case file online was recently i.e. 14 Feb 2013 changed to in process( a valentine Gift I suppose) from re medical received ... what does this mean?

this is very normal.. they are not rqequiring repcc from all the applicants so dont send them one voluntarily.. you will hopefully get PPR soon

By family they only mean you and your spouse and your kids....... and in spousal sponsorship it only means medical of the applicants.......

If I m wrong then group people can correct me cause i m not an authority to it but yes that's how I have understood it and gone through my application.

you are right but if he has kids then his wife and kids medical.. because his kids will accompany his wife to Canada...

Q- Can I stay with my spouse in Pakistan while the application is in process?
If you, the person sponsoring the spouse, is a Permanent Resident then you cannot live in Pakistan while application is going on. However if you are citizen then you can but most people recommend not staying in Pakistan for longer than 3 months as it can raise an objection from CHC that you are not planning to re-settle back in Canada. And they may ask you to provide proof of intention to settle back in Canada which can be letters from family and friends and affidavits or lease of house rent or owning properties in Canada etc.
