I am trying to figure out how to change my status from worker to visitor.
I received a negative LMO last week so I had to stop working. I now want to stay in Canada until the end of August as a tourist.
When I called the CIC call centre, I have been told that I can restore or change my status within 90 days from the expiry date of my work permit. The problem is that my work permit expired more than 90 days ago. Why am I still here and was working up until 2 days ago? Because after about 10 weeks from the submitting of the LMO application and new work permit application, the immigration officer who was assessing my case advised that there was a mistake in the application ( a "technicality") and that we should apply again. At the time (end of May 2013) I called the CIC call centre and was told that I could keep working until I would be notified about a positive or negative LMO.
Do I have to leave Canada immediately and for good? How do I get to stay legally as a visitor? Can I apply from inside Canada? Do I have to leave (say go to Seattle) and come back to Vancouver as a tourist? Is it possible that they refuse entry based on the fact that I overstayed? The lady at CIC centre explained that the 90 days start from when you loose your status and I lost mine when my work permit was denied but my employer nor I didn't receive a work permit refusal letter, only a negative LMO letter.
If anyone can give me advice, that would be greatly appreciated!
