Chances of getting the residence

Technically it's possible to get approved without a PCC. However it has to be impossible to obtain the PCC. My husband was approved for PR with one PCC missing. He spent a year and a half in Kuwait before the war. All of the records were destroyed in the war and it was therefore impossible to obtain a PCC for that period. We tried for many months to get once - including contacting multiple embassies and consulates. CIC accepted our letter and evidence (all of our communications with the embassies/consulates) - and approved his PR visa.

So it is possible to be approved without one - just don't think it's going to work out for your wife. In her case it is in fact very possible to obtain the PCC - she just can't be bothered to try. I don't understand this lazy approach. Why bother applying for H&C and wasting tax payer dollars if you can't even be bothered to do the required paperwork?

Well... I called legit (a government agency that help people to apply for immigration in the H&C, asylum...) and I explained the situation and asked to man on the phone to be frank, blunt, to tell it like it is... Well, he said based on the way she came to Canada (international student spouse), I told him i am a french citizen, and well, he said at first her chances were 75%... then further I explained what the cic said in the letter, how was the letter she sent, and he said 90% refusal... then when when I told him what was in the letter she sent, he said that this letter will simply be dismissed...

This is what I am doing. I just leave her with her belief in Canada... Every time I tell her to not expect much from her application, she gets mad... No later than this morning, I once again told her to not expect much after she said out ofthe blue that she will get her residency... She replied that if it get refused it will be because of me... What? I am not the one with an incomplete application, I submitted all my exam and PCC...
She said u bring bad waves... Ok
Now I am not even thinking about Canada, just the USA,

You are right

It's not worth arguing you love her keep your mouth shut, let her figure it out on her own and if she gets her denial it's not you it her. Focus on you why she wants canada so far

The only reason she wants Canada is to not go back to Haiti... She will forget about it when she will be in the US. Even when she will get the French citizenship she will see Canada s les important

Yes and canada is equally good but why she hate Haiti plus when ever she's goes to us she needs pcc from haiti

Well Haïti is not a good place. Violence poverty, dirty, no future... For the USA, by the time of petition is underway, she will be a French citizen so she could travel to Haiti to get the pcc

My two cents:
(un)fortunately, your wife is spoiled for choice: French citizenship on the way + Canadian H&C (which would most likely get approved if she submits the PCC) + US residency.

If someone desperately wants to get away from a bad situation/desperately wants to live a better quality of life, s/he would put in 110% efforts to make it happen. But given the choice she has, she's become rather complacent.

TBH I think any police clearance certificate is crucial in order for you to get approval on your application. You need to provide both no matter what.. if you don't it may delay your application. I applied under H&c last July and I submitted my stuff all at the beginning including the police clearance from my country and I find it made my application process go a bit faster.. it's now completed and of two months ago just been waiting for the landing interview ..

My advice is the sooner u provide it the better.. the longer u take the more suspicious it will be..

Unfortunately we've already been through this with the OP. His wife can't be bothered to put in the effort to get one.
