Hi,
I hope you are doing well.

My wife is working in canada in ICT work permit(LMIA exempt category) for 2 years in canada. I too came on spouse open work permit and working here in canada for past few months.

Last year, Her company supported PR application and provided supported letter stating the job role and responsibilities and continued employemement after 1 year of getting PR.
But unfortunately, there is no CEC, no program specified draws from mid of the last year till July 2022.

Recently, we got ITA for express entry under no program specified with points claimed for both Canadian experience 2 years and 50 points for valid job offer.

Now, her company providing letter for PR process without mentioning line "she will be employed for 1 year after getting PR". This is due to recent change in company guidelines.

But, she have work permit till nov 2023 and it will be further extended till 2025 next year.

So now we are worried whether to accept ITA and submit the application claiming 50 points for job offer because it may lead to rejection due to incorrect job offer.

Please advise us.

Under the EE (FSW) arranged offer of employment means:

Your job offer must:

  • be recent (usually less than 1 year old)
    • You can’t use the same job offer letter that you used to get your work permit.
  • be in writing
  • not be from an embassy, high commission or consulate in Canada
  • set out details of the job they’re offering you, such as
    • your pay and deductions
    • your job duties
    • conditions of employment, like your hours of work
A work permit on its own is not a job offer, even if it is an open work permit.

Federal Skilled Workers and Canadian Experience Class
A valid job offer has to be:
  • made by one employer
  • continuous
  • paid
  • full-time (at least 30 hours a week)
  • not seasonal
  • for at least one year after we issue your permanent resident visa
  • in a NOC TEER 0, 1, 2 or 3 job

IF your letter, from your employer or offer letter, does not state that it is for at least one year after we issue your permanent resident visa, you will not be able to claim points for it.
