Hello,
I have created my EE profile, but my points do not match with the CRS calculation that I did. I am assuming it's because of the job offer. My EE profile shows under valid job offer not applicable. However, I do have a job offer that meet the criteria they are looking for. Any ideas, suggestion why it's showing not applicable under the job offer?
Note: I am in Canada.
My job is exempt from LMIA

What kind of work permit do you hold? How long have you worked in Canada?
 
Open work permit "PGWP". I've worked for one year full-time NOC B.

In that case your employer must obtain an approved LMIA in order for you to claim job the 50 offer points. Your Express Entry profile is correctly showing that you do not have a job offer at this time. Because you hold an open work permit and no employer is named in your work permit, you must obtain an approved LMIA to get the points.

But in the first place, the employer had employed TS based on non-LMIA decision so how can the employer obtain an LMIA just so to get the points? Won't PGWP holders working in a job be disadvantaged by EE? Correct me if I'm wrong.

An employer can still obtain an LMIA for someone who is on a PGWP. There is absolutely nothing stopping an employer from doing this.

The requirement to get the 50 job offer points is that either you must have an approved LMIA or, if you are LMIA exempt your employer must be listed on your work permit. No employer is listed on a PGWP - so no job offer points. LMIA is mandatory to get the points.

NB: My company has no LMIA no.

If you are on an open work permit, your employer would need to get an LMIA for you to have a valid job offer. You still have to say no. Having a job is not the same thing as having a valid job offer.

I am on a PGWP. So from your explanation i have no valid job offer.

However, on my reference letter for the one year of being a contract employee , it has been mentioned that i am now hired on as a full time employee with the company, should i write a letter of explanation stating why i am not claiming the full time employment as a valid job offer?

Hi , I am working on closed work permit , fulltime permanent position in NOC O with positive LMIA, working since March 2020.

But as per lawyers , it is still not considered as valid Job offer .
moreover, my employer has denied to provide me a Validated job offer.they have again renewing my new work permit with new LMIA(already approved )

I am confused what a valid offer means??

I am in quebec , Montreal currently .
