Hi Folks,

One of my friend is nearing completion of 1 year in CEC. Looks like before completion of 1 year (Say 10 days [paid vacation] before), he needs to travel out of Canada.
In this case when he will be eligible to apply PR under CEC?
(1) Complete 365 days at a stretch
(2) Or 365 days count in which in between he is out of country on paid vacation

If the vacation is paid, it will count towards his experience. Although I will suggest that he leaves some days after the initial 365 days just in case.

Hi Asish,

The requirement of CIC...I quote is as below -

....'To apply for permanent resident status through the CEC, you need at least one year of full-time experience (or the equivalent in part-time work) as a skilled worker in Canada. Full-time work means at least 30 hours per week, and you need to have worked at least 1,560 hours in a year. The one-year of work experience must have been obtained within the three years preceding the date your CEC application is received....'

1560 hours is minimum requirements in one year, so if you meet this in few days less than 365 days it would be OK. This means that vacation (or other) breaks in this stretch would be acceptable and normal.

To put it simply, two requirements for CEC

1. 1 year of full time (at least and also maximum of 30 hours/week)
2. 1560 hours in a year.

If you worked for 40 hours/week then only count them as 30. If you worked 20 hours/week then that is part time. Of course, the above only applies if you are considered a full time employee.

Vacation Time - If you are on paid leave then include that in your one year calculation. For unpaid vacation, don't include that.

One year has to be in the last three years before application date. It does not have to be at a stretch on continuous.

"An allowance for a reasonable period of vacation time will generally be made in calculating the period of qualifying work experience (e.g., a two-week period of paid vacation leave within a given 52-week period in which the applicant was engaged in qualifying work experience)."

So, yes, he is allowed to take a vacation, as long as it doesn't exceed 2 weeks. But it would still be advisable to wait a couple of extra weeks before applying (if possible), just to be "safe."


(1) Complete 365 days at a stretch
CIC counts weeks of employment (52 in a year), and there is no requirement in the CEC class that work experience be continuous.
