Hello everyone ,

I am a canadian citizen who's married to an Argentinean. We got married and currently living in Chile . Now we have a son who's born here in Chile so hes Chilean but I've read that he is automatically a Canadian too because I'm Canadian .

We are currently planning on wanting to move to Canada . My plan is to leave first with my son and live some time in the US then move to Canada and reclaim my husband while I'm away from him . How does the process work for Spouse sponsorship? I'm guessing I will have to do an Outland Sponsorship, how does that work ? And is it usually a 12 month process ?

Were you born in Canada yourself? If yes, then your son is a citizen, though you need to apply for a certificate of citizenship and then a Canadian passport for him.

If you were born outside Canada it's more complicated, but I'm just going to assume that you were born inside Canada. If that's not the case, let me know and I'll give you more information.

You can sponsor your husband right now. Citizens do not need to move to Canada to sponsor their spouses - they just need to show that they will move after the sponsorship goes through.

You can read about the process here -
https://www.canada.ca/en/immigration-refugees-citizenship/services/application/application-forms-guides/guide-5289-sponsor-your-spouse-common-law-partner-conjugal-partner-dependent-child-complete-guide.html

There's information for Canadian citizens living abroad and how to sponsor their spouses. I'm sure you'll have more questions, but read through the guide a few times and then come back and ask.

Yes, it usually takes about 12 months.
