Hi everyone,
Thanks to all for your input.
I recently did landing in Canada along with my family. Immigration office has issued IRPA28 saying that you do not meet residency obligation and you will need to give additional interview. Officer mentioned that I should be receiving this info via email or mail. I have not received anything yet.
I am basically short of 115 days out of 730.
What should be the next step after this?
What things I should do or collect to make sure I clear my next interview.
Thank you again.
You should indeed contact a lawyer to get a consultation.
But there is some chance that although an officer at the border mentioned that there would be an additional interview, that the officer in fact didn't file all the paperwork for further steps, or took it to someone else and that other officer didn't feel it was worth pursuing.
The unfortunate thing with your case is the uncerrtainty. I don't know if there's a good way to get the information on the status of this - it's more common that the report and decision are made at the port of entry. But I understand it is possible that they can do so afterwards and that you'll receive notification by mail or otherwise. I understand some say this can happen fairly quickly after your arrival.
You say here that you are only short 115 days - but in an earlier post, that you'd only spent 3 days in Canada? Since 2022? I know this is mathematically possible, but "I've been a PR for ~3.5 years but only spent three days here" - which the officer may see on their screen by entries/exits - is substantively different than "I'm only 115 days short (because there are 615 days [730-115] remaining within the five first years of PR status)". If that's the math, then in any event you are out of compliance, and it will take 730 days to get compliant - because you were out of Canada for more than 1095 days since you became a PR in 2022.
If that's correct, then regardless, you have two years of physical presence in Canada to become compliant, and if IRCC stops the clock on counting your days, then the 115 days 'short' is meaningless. You are 730 days short.
But pls advise if I've misunderstood.
