Hi there.. I know that this plea for help has likely been asked on here many times, but there is so much info on here, I thought I would try asking again myself!

Basically I am Canadian married to a Brit. I have been living here in the UK for the last 6 years on spousal visa and now Indefinite Leave to Remain. We are now considering moving back to Canada, and I basically want a little guidance on which forms we use and where do I send it? I have had conflicting advice from various places. One saying that when doing an outbound application I have to send it to London, and others saying I have to send it to Canada. If some wonderful person out there could clarify, I would be grateful.

I understand that there is no funds requirement for spousal sponsorship, but as I have been living and working over here for 6 years, will providing this income actually give them a clue as to how we intend to support ouselves when we move to Canada?

Also in terms of job prospects in Canada, my husband currently runs an Internet based Accountancy business which he would be looking to carry on doing once we moved back over. Would this be an acceptable form of employment, or does it actually have to be a job provided by a Canadian employer?

Having been in a relationship for 8 years, and married for 7 of those, I understand that we still need to provide proof of our relationship (which I do find silly).. is it things like utilities bills in both our names etc? Just photos of us together, emails between us when I visit Canada and he stays here? I have seen people saying they sent birthday cards and wedding invitations.. Any suggestions would be great.

To be honest with you it was SO much easier doing the application to move over here!! There was no medical, no criminal records check... it was just proving we had a relationship and that I had a prospect of employment! :)

I think thats it for now, but I am sure I will have many more questions as things progress!

Many thanks in advance
Melissa

Where do you apply = Canada.

See this as a starter:

Income, providing more information helps, but you are right, you are exempt on the financial requirements.

Job prospects depend on where you will be in Canada, and many other things.

Proof has to be provided, take it seriously - everything you list and more. (search the forum, there are lots of lists)

You are doing exactly what my Canadian husband and myself did. He came over to UK to live and we got his application for UK all completed, and now we've moved back to Canada and have had to do the same thing for me, and yes the UK version was sooooo much easier and simpler.

Baloo has given you links to the most really useful threads on the forum, have a good read through them and read the sponsorship and PR application forms including the checklists and if you have any other questions after that just feel free to ask.

I found it easier to go through all the checklists and include everything on it as asked, making sure that there is lots of relationship evidence.

Your husband doesn't have to demonstrate that he has a job over here or even that he will get one, but if you are still in UK when you apply, you as a family will need to demonstrate that you have thought about how you will re-establish yourself in Canada.

Thanks for the links Baloo.. much appreciated!

MandiF- thanks for your response.. am I reading it right that your application took just 3 months to be processed or is that wrong? From the links I have looked at and other people's threads it could take much much longer. Did you apply on an outland application? I see you said you have already moved back to Canada, so just wondering what your timelines have been like. Obviously it makes such a big difference in terms of finding housing, employment, schooling etc. when you KNOW roughly when you can move! ::)

My application went through very quickly and I received my passport request from London in 2 and a half months from initial sponsorship application to Mississauga. I applied outland and although I am currently in Canada, I am still on 'visitor' status, until I get my passport back from London, as I had already decided to come and stay with my husband and wait out the end of the process in Canada when I received my passport request and so had to send my passport from Canada to UK to get the visa put into it, so I can flagpole at the border to officially land.

Everyone is different and really you never know the difference between one person's applications and another's. Basically, my application arrived in Mississauga on 22 Oct, we received sponsorship application approval on 19 Nov and then heard absolutely nothing until I received a passport request letter (not email like most do from London) on 5 Jan. And there have been some other PPRs coming through from London in the first half of January from October applicants as well.

Like I said, you never know the difference between one application and another, but I do believe the fact that we had my husband's spousal visa done for UK first did help, but neither of us had previous marriages and there were no children, so maybe that speeded it up as well?

Good luck with your application and let me know if you have any other questions I can help with.
