Dear cv,

I have a pr card and have lived in Canada for 5 years and am married to a Canadian. During this time we had to leave Canada because my mom was very ill, but we visited my husbands family every year for a month to two months.

Is it possible to apply for citizenship now? We have been outside of Canada off and on for about 12 years now. I Don,t receive much help from cic before leaving on this matter.

It's unlikely you qualify for citizenship based on the information you have provided.

To qualify for citizenship, you must have physically lived in Canada for three years out of the last four years from the time you apply. The time you spend outside of Canada with your Canadian citizen husband does not count towards this total.

If you were only out for a max 2 months per year then in the prior 4 years you would have been out for 8 months (I'm keeping the math simple). If you were to apply and date you application today would you have 1095 days of physical presence in Canada within the period to 4 years ago? If yes then you can apply.

Note that you have to be able to provide proof of this presence. CIC will issue you with a Residence Questionnaire and or/ direct you to see a Citizenship Judge if they have any concerns about your Residency. Triggers for residency concerns appear to primarily be based on employment and the nature of the employment e.g. if you work as a bus driver then CIC will trust your delcared employment more as having being in Canada in contrast to say being a self employed IT consultant with extensive overseas travel via the US (as entry/exit records have historically not been always captured).
