I did my 2 yrs research MS and have got a letter from the Univ stating that I have 4160 paid work hours. For this 4160 hours the NOC is 4122. After graduation, from jan 2008 till feb 2009, I have another 325 in NOC 4122 and 411 hours under managerial class. So my question is will my application go through?
I know in the past all of my friends with ra and ta got their PR.

1) Now with the 38 occupations list, what is the chances of me getting through? i am on open work permit.

2) if rejected, when does the refund of fee comes to effect? is it they see my application and immediately send it back saying it is rejected or will they send an AOR (i am not knowledgeable about this) and then after having received all the docs that they will tell me its a rejection and offer refund?

any suggestions/advice will be highly appreciated.
 
are you applying under FSW 1, 2 or 3.

If you get rejected, you will get your money back but it can take up to 6months. This i dont know for sure, but this is from what i have read on this forum.
 
You graduated in Canada and are now on a post-grad work permit? You can apply under FSW category 3 as somebody who has been studying/working in Canada for 12 months or more. The list of 38 will not affect you. If you don't have enough points for FSW, you can look into applying under CEC or under the PNP in your province as a graduate.
 
thank you guys. the info was very helpful at this junction. yes i was a bit confused about my eligibility for fsw. i am planning to apply for fsw and cec at the same time. the reason to go ahead with cec (even though i am not sure whether cec will go thru) along with fsw is to get pr status asap; eventhough i have another 18 months of open work permit.
i had a lot of interviews going wrong because of my status...initially i used to scratch my head what went wrong until someone called me for a cup of coffee post interview and told me in confidence that one of the interviewer on the board didnt want anyone without long term status in canada. he said they are apprehensive of paper work and LMO's. now i know they are a lot messed up in their head when it comes to differentiating between open and conditional work permit. if SIN no starts with 9....then and there it ends. but i know about exceptions too...but future cant be planned on exceptions.
