Can the immigration border give exceptions under compassionate grounds?

Hi all,

We are in a difficult situation where we applied for BC PNP but its taking to long and could potentially cause an issue with our work as we will need to quit and wait 6 months to come back. We can't extend our work visa as on IEC 2nd year. Looked at all options and it is not looking good. We are thinking of going down to the border to see if there is anything that they can do. Wondering if anyone else has done this and what the outcome was. Our visa is due to expire in 6 weeks.

Any feedback is greatly appreciated.

I tried on the border just one week before expiry date of my WP but they said apply online through CIC only.
i think only way they give you at border is if you have +ve LMO and Job offer. Im not sure about this one.

Thanks for the feedback. Not expecting much from it but worth a shot.

What was your situation? What is +ve LMO?

IECs can't be extended so there is zero chance you will receive an extension at the border. The only thing you can do at the border is try to re-enter as a visitor and remain in Canada without working.

What is +ve LMO?

An LMO (now called an LMIA) is something your employer has to obtain in order for you to qualify for a work permit. An LMIA is effectively approval for your employer to hire a foreign worker. To get an LMIA, your employer first has to advertise your job for a minimum of one month to prove no Canadian could be hired for the role (and yes - your employer needs to do this even if you are already in the role). Then the employer has to pay a $1K processing fee and submit the LMIA for approval. The LMIA application processing takes anywhere from 6 to 16+ weeks. If the LMIA is approved, you can then obtain a work permit.
