Hi everyone.

My girlfriend is currently here from the US on a visitor visa. Ircc approved her to be here for most of the year, but cbsa screwed her around at the border and only let her stay for 3 months. We put in an extension well over a month ago and have not heard back. Her visa expires on the 19th. If we do not get confirmation on whether it will be approved or denied by then, is she able to stay in the country until we do?

Her family is putting pressure on her to leave early, but we don't want to do that if we don't have to because getting back in is such a struggle right now. If it gets denied, she will leave. If it gets approved, she will stay. We just want to know if she can stay after the 19th if we hear nothing.

She has implied status and can legally remain in Canada until there is a decision in the extension application. So yes, she can stay beyond the 19th.

FYI - the visa that IRCC approved only indicates how long the visa is valid for entry into Canada. It has nothing to go with how long she is allowed to remain in Canada as a visitor. IRCC did not approve her to be in Canada for most of the year - all they did was approve a visa that allowed entry for most of the year. The decision on how long someone is allowed to remain in Canada as a visitor when they enter the country is up to CBSA.
