Hi

I have a question about the returning to Canada

I am a new PR. I have landed to Canada on 20 April 2013. My PR card will expire on 18 June 2018. From the day of landing After 2 weeks, I came back to Japan for my work.

I intend come back to Canada on December 2017.

Will I meet any problem when I re-enter to Canada ( I am worry about that the immigration officers will stop, don't let me re-enter ?)

Because from the day I intend to come back to my PR expire day . Don't enough 730 days to keep may PR status.

You will be allowed to enter but there is a very high risk that you will be reported for not complying with the RO, leading to the eventual loss of your PR status. The expiry date on the PR card is not relevant in the calculation of your compliance with the Residency Obligation requirements. It is based on the 5 years from the date that you become a PR.
 
1. Its a bad idea to use your actual name on a forum like these...CIC and CBSA hang out here too.

2. Your question is asked here every day...the answer is always the same....if you are in breach of the RO when entering Canada or seeking any other immigration benefit such as sponsorship, PRTD, PR Card renewal you may get reported. What will happen if you lose your PR Card in early 2017 and have to get a PRTD? Or how about once CBSA implement as planned the requirement for all PRs to provide their PR Card/ Status as part of the current API flight manifest scheme pre-check in which a little birdie tells me may involve cross checking entry/exit records for RO compliance?

3. Sentiment both public, political and in the legislation is that PR status is for living in Canada...its not a glorified visitors visa...one day that free pass will be used up!

My Mom is living in Canada now, her health is not good recently.

I just want to find the right way to see her once a year.

I just want to know what kind of visa I can apply, and what can I do to enter Canada by the right way
( because I don't want I am in a high risk & be reported )

If you never intended to live in Canada and don't care if you lose your PR, you can just continue visiting as long as you can. If you get reported for not meeting the RO and lose your PR, you can apply for a multiple entry visit visa.

If you do care about keeping your PR, you should make sure you aren't outside Canada more than 1094 days in the first 5 years since you landed. You are not yet at risk. You would need to return by early May 2016 so you can still think about it. In the meantime anything can happen. Your mothers health may get better or it may get worse. At that time, you may have to look into options like living in Canada to be closer to her or bringing her to where you are living.

You want to be a visitor to Canada and would normally apply for a visitors visa. You will not be issued a visitors visa as long as you hold PR status. As per Leon either relinquish the PR now and apply for a visitors visa or keep using the PR card as a glorified visitors visa until it expires or you get reported. If you escape report pre current PR Card expiry then CIC will still be waiting at PR Card renewal date/PRTD application date and so will CBSA at each entry (if you are using a visitor exempt passport).

Sorry for I am not good in English. I want to confirm that If i don't care my PR status loss . I can enter Canada (eventhough staying outside over 1094 days) until I get the information (or documents?) from CIC that I have lost the PR status. After that, I can apply for a multiple entry visit visa? am I right ?

Yes, you may continue to enter Canada with your PR card even if you have more than 1094 days outside until you officially lose your PR status. After you lose your PR status, you can apply for a multiple entry visit visa.

ive always wondered if CIC checks this forum or if officers from CIC work on this forum,,,maybe Leon or scylla(complimenting their knowledge) lol :P

It would be extremely naive to assume that neither CIC or CBSA (or even CSIS) use this forum for intelligence purposes. If they have people "officially" present as members, the last thing that they would do is identify themselves. So, your question is rather futile.

I recall one member saying he and his family was caught at the border trying to enter Canada without being able to meet his RO, even though his PR card was not expired, and that he felt they were on the lookout for him. he blamed that he was a little too generous with information on the forum (about trying to comeback to Canada despite being away for more than 3 years) since he was a national of a country with a small population so looking for the family makeup he described in the forum (wife and 4 kids from country 'x' planning on trying to enter Canada on a particular date) was not hard for CBSA. I don't know if his assumptions are true or not but he claims they seems to already know some details about his plans.
