Me and my wife was a landed immigrant. I came to Canada last July 2001 and by Oct. 2001 we have our first child. By March 2003 we moved to USA and worked on an H1B Visa and since then I haven't returned to Canada. Is there a possibility thta I can come back to Canada to retain my status as a Permanent Resident Or I need to apply again? We didn't got our PR CARD which was released on Sept 2003 so as of now we only have our Landed Immigrant Papers or IM 300. Though I still paying income taxes.

How about using what they called TRAVEL DOCUMENTS? I read some guys here with similar problems and according to them they were allowed to enter the border and have 30 dyas for an appeal, is that possible for my situation? regards

Since you don't have a valid PR card for your travel, you would have to apply for a permanent resident travel document at http://www.cic.gc.ca/english/information/faq/pr-card/pr-card-faq11.asp but you have to fill out a residency obligation even for that.

You can come as a tourist or you can try to get a temporary work permit again and apply to a provincial nominee program to get your PR back. For example you can try http://www.albertacanada.com/immigration/campaigns/h1b.html

If the OP comes as a tourist, at the Port of Entry, he will either have to voluntarily relinquish his PR status to enter or be reported and have 30 days to appeal his loss of PR status.

I'm trying to figure out how you are still claiming CCTB

http://www.cra-arc.gc.ca/bnfts/cctb/fq_qlfyng-eng.html

4. Can I get the Canada Child Tax Benefit?
To get the CCTB, you must meet all the following conditions:

you must live with the child, and the child must be under the age of 18;
you must be the person who is primarily responsible for the care and upbringing of the child;
This means you are responsible for such things as supervising the child's daily activities and needs, making sure the child's medical needs are met, and arranging for child care when necessary. If there is a female parent who lives with the child, we usually consider her to be this person. However, it could be the father, a grandparent, or a guardian.
you must be a resident of Canada; and
you or your spouse or common-law partner must be a Canadian citizen, a permanent resident, a protected person, or a temporary resident who has lived in Canada for the previous 18 months.
