Hi,

I got refused on May 27th 2009 as the immigration officer at sydney was not satisfied with my work experience which corresponds to Financial Manager 0111. I was fooled by agent who told me that i got rejected on June third week. When i looked at the duties and job responsibilities, he drafted it poorly with spelling mistakes and not even took required jobs. On top of this, he also filed an appeal without informing us. I am still waiting for appeal response but know that it will be rejected again because of poor description of job and also there is as such no procedure of appeal.

I work in investment company in accounts and finance department. My company gave me title of Investment Manager as I look after everything including investments, planning, budgeting and processess.

I want to re-apply. Shall i do that...i am very confident about my work but rejection and then appeal ...what shd i do? I am being fooled by agent? shall i wait for some time

Can you please tell me when did you apply to CIO. Yes you can surely apply again. I have under NOC 0111

Why did you let your agent to write your duties ?? it belongs to you only because you are the person who has been doing these duties at work, so i don't think that it is a good idea to let anyone else write your job duties.

In order to make your duties match the once at NOC website you should have had a look before you write them on your application and try to re write them again in your own way but without getting away from the basic meaning of them, the reason of my suggestion is because visa officers are not specialized at job classifications and description , this means that they usually use the NOC website to compare your duties with the stated duties over there, then if they find any difficulties in making a decision whether the duties are similar or not they will likely reject your application (especially at sydney nova scotia) because they are not allowed to contact your employer or make an interview with you to verify your duties. The only thing that affects their decision on your application is what duties you have writen in the application and not any thing else at this stage in (sydney), because as i told you they don't have any supporting documents or any authority by CIC to contact you by interview or contact any third party for verification purposes.(in my opinion, that is the worst thing in respect to the immigration rules under the new system).


I really believe that the idea of the CIO is waste of time and efforts for the immigration officers and the applicants and it has a lack of assessment's credibility because there is no supporting documents at that stage as a result any one can write anything he wants even if he was dishonest in his given information they will not be able to verify at this stage in the CIO, so they might give an approval for applications that don't really meet the requirements or refusal for applications that really meet the requirements. Another point, the local visa office will review the application again from the zero point instead of beginning from the point in which the CIO has finished.

1. $$$$$ It is a h**l of a lot cheaper to hire Clerks at Sydney to weed out the applications that don't qualify "List of 38" FSW 2,3, then it is to employ a Foreign Service officer, @$58,700 per year plus housing allowance, travel, cost of housing compared to a Clerk making $38,000. The FSO only then looks at applications that may qualify rather than every application that arrives through the door.
