can application be rejected without birth certificate

Dear Seniors,
A member on this forum wrote that his application was returned due non availability of spouse birth certificate.
Kindly put your comments on it , I think 10 class certificate is acceptable as age proof as many members have got through with it.

Yes. CHC accepts replacement docs but better send an explanation letter for reasons of non-availability of particular document

Paramjit: Since you applied before 26 June your case is different.

Rules for new applicant, after 26 June 2010 have changed.

FYI, the new applicants have to send all the document to CIO with first application itself (NOVA Scotia). NS team do not understand that most of the Indians before 1980's do not have Birth certificate and Xth marks card is their birth certificate. Otherside this fact is well known to Delhi VO. So the applications after 26/6/2010 sent to CIO in NS got rejected without birth certificate.

I understand you would be submitting your documents to VO Delhi only, hence for you it should not be a problem.

Hi Paramjit,

As per my experience, you should send your birth certificate in order to avoid any kind of delay in your case.

I have seen many people who were asked to send their birth certificate eventhough they have provided their educational certificates on which DOB is mentioned.

Rest is all upto you.

I have read somewhere in the CIC website that if there was a certain document that they asked for that you cannot provide, you can submit an alternative document, but with a written explanation of why you were unable to provide it. In our country, there are cases where birth cert files are lost because of calamities, fire, etc. you can submit an notarized affidavit instead of this document.

That is why if you are planning to apply it is best to prepare important documents beforehand if you can.

Answer would depend on whether it is for a pre June 26 applicant, or someone from June 26 2010 onwards. Unlike the latter, pre 26 June applicants only need to sent their supporting documents following receipt of their 1st AOR to their respective VOs - who unlike CIO would be more familiar with local norms and practices. Perhaps in time CIO will be in sync with the VOs; but from the case mentioned they are not quite there yet...

I don’t think they should refuse you for not submitting DOB I was asked to submit when I did not submit in my first application. Well, from what you have said VIO differs.
But I think it should not be an issue.

But I will like you to clear me with this if additional document is requested will they start processing my application all over despite the status shows “in process”
