Hi guys,

I am in USA now and need to visit Canada shortly (with visitor visa). But if we leave USA we must get new visas to enter USA again because our visas had been extended after coming to USA. So it will be expired at the moment we leave USA border.

I was wondering whether I would need to go back to my home country to apply for USA visa or could apply from Canada. As my husband is doing job in USA we need to come back here on time after visiting Canada.

Please suggest whatever you feel right.

I'm not conversant with the US immigration system but I'm assuming that once you know your status will expire after you leave the US, why not apply for extension of your status before leaving? Your husband works in the US so I don't think this should be a problem. You mentioned that your visas had been extended after arriving in the US, does this mean you're limited to extending from within the US only once? I'm not very clear about your predicament, probably if you could explain further, others may be able to help with suggestions.

We can extend our visa in USA legally. In fact we are on extended visas.
And if I say more clearly, according to immigration rules if somebody extends his or her visa after coming in she or he loses the visa and get different legal papers (I-797) for staying here. This papers become invalid if you go out of USA. In that case one needs to get US visa again from a different country.

My question was whether I could apply to US embassy (in canada for getting visa to enter USA back) with my canadian visitor visa or I must go back to my home country from canada and face US embassy there to enter USA again.

My online status showing decision made 3 days ago ... Bu no ppr yet ... Any idea how long will take for ppr after decision made.

If you have a job with valid work authorization in the US and currently not out of status there, you can apply for a US visa and easily get it while in Canada.

I do understand your predicament now. To be on the safe side, I think you should call immigration and ask them or check their website just to be very sure before you leave. But I think since your husband has a job, there shouldn't be any problem. All the best.
