Hi All,

My brother has an IT company registered in Saskatchewan since past 4 years. Below are some facts:

1) Its a small company with an employee or two only
2) There is not much revenue but there are receipts here and there

He is now in expansion phase and would like me to join him. My questions are as follows:

1) Can he issue be a Job offer letter?
2) How likely it is that the offer letter will be approved by relevant authorities?
3) Just because he is my brother, could that be a problem for me in any way?
4) Any suggestions to make the whole case more solid before we proceed?

Thank you all for your response.

I would not recommend you faking your job offer.

This is not faking actually. Since he is expanding, he needs officer manager/accountant for him. So, there is a legitimate need for it.

Okays. But you will also require a valid LMIA

Agreed that the BUMP came in too early! :)

Getting too restless with this immigration thing - need to cool down!

thank you for sharing the link. I will read up.

I think a company in Canada has to show evidence that they advertised the vacancy in Canada for a period before they can sponsor a foreigner.

Instead ask your brother to help you get a LMIA job. that would be at least reasonable to do.

CIC website has all the do's and don'ts for Employers who are looking for talent from outside Canada. First and foremost is, of course, they need to get LMIA clearance to go for international hiring.

Your brother can help you get PNP from Sask as well. Or get you a job that is already cleared by LMIA as suggested in this thread. There are many ways.

Bottom line is, offering a job to a family member or relative is not illegal as such, provided Canadian rules for immigration and international hiring are followed.

Just to get this right, if brother has a company, is in need of an employee, why should be there be any harm in trying for LMIA with that?

Thanks. Makes sense. Its all straight actually if it was someone other than a relative offering me a job, people would ve probably congratulated me I think since it could potentially give me 600 points in SINP PNP! :)

He'll need to meet the LMIA advertising requirements before he can apply for the LMIA. It's quite possible this will cost him several hundred dollars to meet this requirement. He'll also have to spend time gathering the paperwork required for the LMIA about his company and he needs to be willing to submit and share this information with the government. If he's willing to do all of this - then no harm.

If he can get you LMIA...that is the best. No body can raise any issue for a brother hiring a brother !
