BOWP Rules Changed !!!!

Sombody applied BOWP on August 10 and got approved yesterday.
He is OCT 6 CEC applicant.

even though i heard from whole bunch of people that once one will get the AOR,it's 99% no rejection except some medical issues...
but i'm myself not too sure on this though...
anyone else wanna make comment on that...?

Guys I just share my situation my BOWP was refused last December 3. I apply last Aug. 11 using AOR. The reason was notice of receipt of APR does not constitute Acknowledgement of Reciept because application was still prospective.. What makes me disappointed was they just refused my BOWP without opening my file. I didn't get any update about my application since AOR. Almost 4 months no update at all even medical passed. I can't view also my e-CAS. Very frustrating because we have no more status. We have a new baby and we have no more source of income. We don't have any back up plan coz we are very confident that AOR is enough.. Before my work permit expire my employer apply me for LMIA but he cancel the application when we apply the BOWP coz he is confident also that our application will approved. And now we are planning for next possible step if we apply for LMIA again.

I can see you are an EE applicant. Im not so sure if your case is referable

Guys,

I inquired with my lawyer regarding the recent changes in the BOWP rules.

Here my question to him:

"... actually the reason of my concern is clearly indicated in the snip-shot that you’ve attached in your previous e-mail.

To be precise in the snip-shot it’s written that …. in order to be eligible for a BOWP the APR must have a positive eligibility assessment. The positive eligibility assessment is considered to be made once the status of the Eligibility field in GCMS is set to “Passed” AND an Acknowledgment of Receipt letter or e-mail has been sent to the applicant.

Now, with the word AND I assume that both criteria need to be met in order to have a positive eligibility assessment that allow me to apply for the BOWP. I understood that the AOR letter has been received, but, I’ve never seen my GCMS notes, so I’m wondering if my GCMS notes have the Eligibility field set to “Passed”.

My concern is driven by the fact that I’ve seen on-line forums where the most of the applicants under the CEC stream (from June 2014 till Dec 2014), due to the long delays still today have their Eligibility field set as “In Progress” even if they already received their AOR months ago.

Please confirm. ...

Below the answer I got from him today:

"The changes of the past week suggest that acknowledgment of a complete PR application will suffice to be eligible for a BOWP for pre-2015 applications .

Across the board, CIC has not been using the “passed” terminology as had been planned for these files; CIC is by-passing this stage altogether."


It looks like that nothing changed for pre-2015 applications, but just in case lets keep an open eye on it.

Note: my visa expiry on may 21st.

Did you apply for PR before 2015 or did you apply through EE?

I believe the AOR concern is only for EE applicants. I have gotten BOWP once and extended twice (second time extension after COPR).. so I dont think pre-EE applicants have anything to worry about.

Guys, one of the worst days of my life!

My Extension for BOWP got rejected today.
i have applied for my PR in Jun 2014 under CEC.
I have received AOR in Aug 2014 based on which I have got a BOWP which expired in Sep 2015.
I have got MR in Feb 2015 and finished Medicals in March 2015.
In Aug 2015 I have applied for Extension and today they have rejected it.

I have a decent job, I am renting a Condo, my Car and all my stuff and I have to leave Canada all of a sudden. Seriously ?

did you attach your AOR with the application ?

can you list down the documents which you attached with the application ? i understand this was your second BOWP, but did you apply yourself or authorized someone else to take care of it for you ?

This doesn't even make sense. Why would anyone apply for a work permit if their PR application is approved?

Yes, I wrote a cover letter and attached the below:

1. a Fee payment receipts – fee for extension of open work permit and fee for open work permit holder fee.
2. a Document Checklist (IMM 5556)
3. a Application Form to change Conditions, Extend my stay or Remain in Canada as a worker (IMM 5710)
4. Copies of pages from my Passport.
5. Copy of my current work permit
6. Copy of Email correspondence of acknowledgement of receipt of permanent residency.
7. Letter from Employer for extension of employment.
