Baby born in India - Single Parent - March 2023

Hi,

I am a Canadian PR holder. My daughter is born in India in March 2023. I am, at present, on maternity leave. I have applied for the passport for my daughter and hoping to get it by July/Aug.

I am looking for advise on sponsoring my newborn so I can bring her with me to Canada. Since she is born to single parent, I can't leave her behind to process her PR from within Canada.

Can you please suggest how do I present my case to IRCC to expedite her TRV/ TRP or PR? I have the sole custody of my child.

You can only submit the PR application once you have returned to Canada and are living here. You cannot sponsor your child for PR while outside of Canada.

For the TRV application, there is really no way to expedite. As soon as you have the passport, apply for the TRV and hope it is approved. If not, then you can pursue a TRP. Note that you'll need the other parent's written permission in order to bring the child to Canada.

My newborn’s biological father has chosen to stay anonymous.All her identity documents (birth certificate, passport etc) are without father’s name.

I am unable to furnish the other parent’s written consent in this case. I do have affidavits supporting my sole custody.

This could be problematic when it comes to travel and sponsorship. There is no proof that the father is aware of the child’s existence and that they don’t want any involvement with the child. There would also be the issue of citizenship of the child. We’re you in Canada when you got pregnant? Would suggest they legally relinquish their rights if they don’t want to be involvement with the child.
