After almost a year of waiting since the new ruling on June 2013 allowing failed examinees to do retest, today i just did it. I received the notice on April 17 for May 6 test. I could have taken the exam on Dec. 16, 2013 but unfortunately i was out of the country when they scheduled my retest. Immediately upon my return on Dec. 28th, I sent them a letter of explanation why I missed the test. Thank God they have accepted my explanation and after a few months, they were able to schedule my retest.

After the exam, I was told that oath letter will be sent from 3-6 months but might be sooner.

Timeline: Surrey (family application with husband and 1 kid)
Received application - Aug. 2011
In process - January 2012
Test - Sept. 2012 (failed)
Retest - Dec. 16, 2013 (missed)
Letter of explanation - Dec. 30, 2013
Followed-up with Cic - Feb. 15, 2014 ( they said, i will be scheduled for retest and wait until May 2014)
Followed-up with Cic - Apr. 17, 2014 (they said, letter was sent on Apr. 14 for May 6 exam. True enough, i got the letter when I got home from work)
Retest - May 6, 2014 (19/20 passed)

In between this timeline, on Feb 2013 I learned that I failed my first test but my husband passed. I requested for separation of file right away and was granted sometime on April 2013. Before my husband and kid received their oath letters, husband was asked to do fingerprinting. Husband and kid took their oath on the third week of May 2013.

Please note, when i requested the separation of files, the new ruling wasn't in place yet. Since there's a new ruling, there's also a new procedure with these kind of cases.
