Outline of situation:
- I am from the UK, married to a Canadian for 7 years, have a 6 year old daughter.
- We were living in the UK. Decided to move back to Canada.
- I entered Canada on August 21st as a visitor, with the understanding we would do my PR application straight away.
- Wife said she couldn't sponsor me because her taxes weren't filed.
- November 24th I filed to extended my visitor status (i.e. get a "Visitor record")
- Visitor status expired January 20th
- Visitor record refused on February 24th.
- Spoke to an immigration lawyer who said I have 90 days to regain status - which takes us to May 24th.
- Wife finally filed her 2021 Canadian taxes on March 19th 2023, and thus I should be able to apply for PR now.
- If I apply for PR, will being here 'out of status' hurt my application?
- At this point is it better I go inland or outland application? (I was told that you can apply for Outland even if you're in Canada).
- Will applying for PR give me status? ("Maintained status")
- If applying for PR does not give me status, what should I do?
- What happens if I stay in Canada and my PR is denied - what is my status then?
