Hi,
I and my wife are in Canada since Aug2012 under work permit. Are we eligible to apply for permanent residency? I have heard few of my friends telling that we need to complete 1year of stay in Canada to be eligible to apply within Canada. Is it true?
 
Different immigration programs have different requirements. You will have to research the various immigration programs on the CIC web site to determine if you qualify to apply and when.

If you don't have time or aren't comfortable doing this research yourself, then I would recommend that you hire an immigration consultant or lawyer to assist you.
 
If you apply under Canadian experience class, at least one of you needs to have a skilled job and have worked full time for at least 1 year as well as pass the IELTS.

When I get my PR, What ll happen to my PR status if I am not able to stay in Canada for min 2yrs in every 5yrs?
 
You will probably lose your PR at some point when they catch you. They may catch you because they suspect on entry to Canada that you do not meet the residency requirements and decide to report you. They may catch you when you apply to renew your PR card without meeting the PR residency requirements or they may catch you as you are outside Canada, your PR card has expired and you apply for a PR travel document without meeting the residency requirements. You would in all cases have a chance to appeal for your PR but without a good reason, you would lose the appeal and your PR.
 
I need some information regarding sponsoring spouse. I was refugee and my case has been denied. I didn't apply for appeal or anything. After 8 months I got married to Canadian Citizen. Now he wants to sponsor me as a spouse.

My question is do I need to change my status before applying for sponsoring spouse or am I still eligible to be sponsored. I didn't receive any removal orders yet.

Somebody told me that I have to apply for change of status as I have to come on visitor status first and then my hubby can sponsor me but I read somewhere on CIC website that from MAY 17TH, 2013 . Canadian can sponsor illegal spouse no matter what status.

If you want to make sure you don't have to leave Canada, apply inland. If they try to deport you, you can fight it based on having applied inland.
