Applying for PR after getting married

Hi everyone!

Just a quick question regarding my sister's situation... She will be getting married to a Canadian Citizen pretty soon and then applying for permanent residency.

She is currently living in Canada with her fiancée and I was just wondering if getting married will help have a faster processing for her PR? and also, should she apply Inland or Outland? I've heard Outland is faster and she will be able to travel in and out if she does it that way.

Any recommendations?

Canada has no K-1 ( fiancé visa) so it falls into 3 categories for such a situation

Spousal- by marriage (same sex or otherwise)

Common law- where you live together for a year then file

Or a conjugal sponsor- which is a marriage like relationship but cannot live together (i.e spouse can't get a visa) This one is very difficult to prove so I wouldn't suggest it. And if you are visa-exempt, it won't fly.

So you couldn't even apply without either living together a year or getting married first. And unfortunately ( for most of us on here) marriage doesn't fast track the process. The more straightforward the case is ( i.e complete paperwork, lots of proofs ) helps a great deal but there is no fast lane. Also, if they've had a short courtship, big age difference and cultural differences these are all red flags that slow or halt the process.

So in short, don't rush to get married thinking it will speed it up when in fact it may slow it down if you've had a very short courtship with minimal proofs. Gather as much proof as you can of the relationship (I,e pictures, boarding passes, trip receipts even letters from family members) then send in your application when you meet the qualifications. The sticky topic at the top of the spousal page is an invaluable resource for those just starting out. I hope this helps.

you would need to specify what country your sister is from so we can give you better advice regarding inland vs. outland. for visa exempt countries such as the US, it is generally recommended to apply outland, since the processing times is considerably less than inland. For example, for a us citizen, an outland application takes about 8-10 months to receive PR status. For inland, it takes about 9 months just to get through the fist stage of approval (known as AIP). After first stage approval, the applicant can receive an open work permit, then it can take another 8-10 months for second stage approval. For visa exempt applicants, there really isn't any benefit to applying inland - in my opinion.

My sister is from Chile but right now she is living in Canada with her (soon-to-be) husband.

Visiting, remember visiting. ;) If Immigration thinks she's 'living' in Canada without the status to do so, it could cause a whole mess of problems. Visiting her BF/fiancé/husband is ok as long as you follow the rules.

then inland is probably the best way to go, i would think, since she's already there legally.

Ok, just checking. I'd hate for her to get into trouble so I was making sure. I'm very careful about it, especially when I leave or if my parents visit as I am visiting my husband in Canada while I'm applying. My parents know the rules I have to live by so the don't get us in trouble. ;)
