Applying for PNP and spouse out of status

I am applying for PNP nomination/Express Entry and am mentioning rightly that my spouse is PR, who is out of status. I am also PR, but would be relinquishing it because I am out of status.

Would it cause any issue? Is this right or my spouse should also relinquish?

We have retained his PR just to consider taking chance for allowing port of entry (PoE).

What would you say?

What do you mean by you are out of status and then retained his PR. its so confusing. Who is in PR status now?
You meant "not met" the residency obligation? How do you know that you are out of status?

Me and my spouse both are are PR but have not meet residency violation.
I am now planning to relinquish my PR and apply through PNP.
My spouse is not planning to relinquish since we feel like taking one chance at POE.

So, the query is if I mention in my PNP application that my spouse is PR but have residency violation, will it cause issue with my application or my spouse status?

It might complicate because your spouse would be still on PR status. Why dont you wait till his try at the port to see if he/she is successful. Then you can decide if you want to renounce your PR and apply for pnp.

Personally, I wouldn’t relinquish your PR until you’ve at least attempted to enter Canada and find out if you are reported.
Agree but you have to be prepared to stay for 2 years if you don’t get reported. Do you have SIn #? Health card? Without an valid PR card you may not be able to renew health card in some provinces so you will have to consider this based on your situation. When did you land? How much time did you spend in Canada? When did your PR card expire?

Me and my spouse PR card is still valid for about 1 year 10 month, its due to expire on March 21.

We are out of status by about 3 month. We have Sin, but not Health card (never applied).

We did landing in March 2016 and visited twice for brief duration in Dec 2018 and Jan 2019.
