Hello Everyone,

I became a permanent resident of Canada in 2003 and stayed in Canada till 2004. After that I came to USA and have been here till now. So I have been outside Canada for more than 4 years without accompanying canadian spouse/relative or working for canadian company.

I think I'm now no longer a Canadian Permanent Resident. My Canadian PR card expired in March 2008.

Question I have is now that I need to go back to Canada, do I need to re-apply for Permanent Residency? If so, will my application be denied since I was not able to fulfill my residency obligation the first time? Are there special application procedures for second time applicants?

1. You have apply from the beginning and must meet the new FSW class requirements.
2. Before and office would process your application, you would have to give up your PR status, although you don't meet the residency requirements, you still could enter Canada and appeal the loss.
3. CHC will probably question your motivation for emigration.

I think the appeal process will be risky and more expensive. I did the self assessment test and still qualify to immigrate (infact I'm more qualified now than I was the first time i got the Canadian PR). Question is what do I do with the old Canadian PR card? Do I submit it with my application or is there a separate procedure for handing it in first? Or should I simply submit my application as any other first time immigrant?

Anyone in the same situation I am?
