We havent looked into extending the visa- perhaps thats our best bet while waiting for the family sponsorship visa to be processed. He is working only part-time at Indigo (the book store) although he also has another full-time online job with a south african company which recently opened a satellite office in Toronto (the company is now registered in B.C). He is their main employee here in Canada so I guess he could try get an LMO for that? Its in the internet marketing field. Should he just try get an LMO anyway? Or would failure to secure an LMO somehow interfere with the common-law application.

My other concern is about the forms I have to submit- it seems I have to submit a tax form from the most recent tax year- so I guess if we submit in August 2013 ill include my tax forms from 2012- would my financial situation jeopardize our application? Im a student with a part time job and I make all my money in tips so would they penalize me for that? I.e would i seem unsuitable as a sponsor? i do have a trust fund in my name which I could show proof of. perhaps that would help?

Just started looking into all this tonight so i have a million questions!

As I said i am not the expert as I applied outland. But I can not see how trying for a LMO would hinder your application. Just be honest in everything you fill in on the forms and it goes from there.

Financially there is no requirement for spousal sponsorship. It is just that you can support your spouse and are not on welfare. As for taxes. Submit your 2012 option C printout (from taxes) and for every form and question you have the opportunity to explain or add information you feel is relevant. So feel free to explain how you will be able to support your spouse and you. It does not affect your sponsorship as i know people who have been approved as students on student loans.

I have been following this forum and have luck with my questions so far and I still need a few answered, i dont want to have to pay for an immigration lawyer in toronto!

firstly my boyfriend and i have been living together in Toronto since 14th august 2012. He HAS to leave as per his visa indicated on the 13th august 2013. This means, as his passport will reflect, he has been in Canada 364 days and living with me that long. We just joined our bank accounts, we're in the process of getting some life insurance but otherwise we have mail to this address from both of us and can probably get a letter from my landlord. My question is- do we not qualify as we have been living together for under one year in Canada?

I hadnt thought to worry about all this because we DID live together in Cape Town for over a year before i moved here last january (we were apart for six months). But we have absolutely no proof that we did live together. my mom owned the apartment and she can obviously verify this, as can his parents, but from what ive seen on other forums we need some mail sent to that address. I have mail but he kept his mailing address as his parents house because we werent that concerned with our future canadian visa applications at the time and it was a pretty casual arrangement (he didnt pay rent, he just lived with me in my room). So im so stuck! Do we wait till august to hand in our application and then go with the 364 days of living together with solid proof or should i just apply now with the evidence of our Canadian lives and some evidence (in the forms of certified letters) of our cape town cohabitation?

the reason why i am worried is because he has to leave in August, and i have to stay- we dont want to be apart for eight months to a year if we dont have to!

Hi. I will offer what insight I have, however it is just my opinion!

For the time you lived together in Cape Town you could get notarized letters from your parents that you lived together including the dates. Since you have already lived together a year, you would qualify for common-law. I have heard of others who lived in similar situations and did not have any bills or expenses for rent just letters from their landlord, in your case your mother.

I would collect everything you have here which would support a continuing relationship. Include your means of communciation while you were apart. I would say you can apply before he leaves. However I would post this question on the spousal sponsorship thread for a senior member to clarify. Just my two cents!

Good news. My husband has been approved! The only catch now is locating or re-doing the US criminal record check which didn't get to Pretoria. While this could be a delay of a few months, there's relief in knowing the end of this process is in sight.

I don't know too many details in terms of the specific questions he was asked. Apparently it started with then stating that they didn't believe our relationship was genuine, based on a few statements in our emails...that were taken out of context. In the end, though, the photograph evidence and the fact that my husband knew alot about my rural area convinced them otherwise.

I expect I'll get more details over time, especially when he finally gets here. I'm crossing my fingers that the criminal record check can be found at the Mississauga office so we don't have to redo it and wait the 4 months or so it will take to get it. Best case scenerio he's here in a few weeks. Worst case a few months. The hardest part is over though 'cause we know he's on his way.
