You are welcome loveworld. So, did you finally get the AOR number or not? 64 weeks is worrisome. I thought they were trying to keep it under a year. But, 64 weeks is 15-16 months, which is much more than a year. God gives us patience.

There seems to be a lot of movement for applications sent in March-July 09, I mean, a lot of recent transfers from Buffalo to NYC, Detroit, or LA, thus a status change from "Received by Visa Office" to "In Process", but there seems to be no movement for applications sent (in the same period) by people residing in Canada--foreign students & workers like myself, who I think are at a disadvantage. What do you think, guys?

Unfortunatly, with Buffalo not before 9 months and in many cases after 12 months.

I sent my FSW3 application to Buffalo in July 2009, and received the AOR from Buffalo in the same month. I'm currently a graduate student in Canada but plan to leave the program soon without completing it. My question is how to legally stay in Canada while my FSW app is in Buffalo? I don't want to leave Canada while my application is in Buffalo. I think I can drive across the border to the USA and come back and enter Canada with a six month visitor's visa without any problem. My hope is that my case is finalized by the end of this year. Is anyone in a similar situation? It's hard to get a job and a work permit these days, and I don't want to enter another grad program even if it's a fully funded program like the one I'm currently in. My last option is to leave Canada after changing the address to my relative's address in Canada. I'd appreciate any advice or stories.

No man what are you going to do ! people are dreaming of your situation "having a work or study permit while their applications are being processed at Buffalo and you want to lose your student status !

Bear in mind that changing your status from a worker or student to a visitor in canada is very easy process but vise versa is very difficult.

You are saying that your program is fully funded and you want to change to a visitor ? if you change to a visitor and your application in Buffalo takes longer than you expect, you will have to leave canada, whereas if you have a valid study permit, no one can ask you to leave the country as long as your study permit is valid.

changing from a worker or student to a visitor does not need to go to the borders, just send an application of change of status to the immigration department inside canada, and they will process it and change your status to a visitor for 6 months or less( you never know it is up to them). However, again if you do so, you will regret for losing the student status which is safer than the visitor.

Hi mainimehta, actually FSW 2 is supposed to be faster than 1 and 3, at least that is what some applicants under that category claimed with other visa offices like london. They received a letter from london visa office stating that their applications might be processed faster than the usual manner and asking them for more documents.

However, i have not seen any Buffalo applicant under category 2 received such a letter ! so i guess that Buffalo does not consider any difference between the three categories, they are just super slow office.

regarding your temporary residence status" the work permit", unfortunatly you will have to find your own way to extend the status in canada, they are not going to give you any exceptions in that regard(means they will not extend your stay in canada as a worker just because you have a PR application in Buffalo, you will have to meet the requirments for the renewal, and another bad thing in your situation is that they are asking applicants under category 2 to have their work permits valid at the time their application is made, and at the time of the visa issuance (i don't know why did they change it this way to make it more difficult !).

For me, i sent only photocopies of everything except the following:

University certificates "degrees" originals

Transcripts"originals in a university sealed envelop"

Certificate from my old school in canada "notarized copy"

Employment letters "originals"

IELTS test results "original"

letters from my current school in canada"originals" along with transcripts "originals".

police clearance "originals"

some other documents related to the bank account, proof of relatives in canada "originals"... and so on.

and any document which needed a certified translation"a notarized copy of the document along with the certified translation was sent"

The job is good and everything but I would like to live with my family in Canada rather than here alone. So, I am thinking about applying for federal skilled immigration visa. My question is: Can I apply from here and select New York or buffalo as my processing office (these 2 are the nearest options for me)?

I read it on the immigration website:
Determine which Canadian visa office is responsible for:

* the country in which you are residing, provided you have been lawfully admitted to that country for at least one year; or
* your country of nationality.

I am hoping that the first point means, I should have a visa for over a year to stay in US rather than I should have stayed in US for a year before I could do that. Its been only a month since I have come here and would feel like eternity if I am to wait another 11.

I sent all my notarized documents to Buffalo except my Passport’s copy, pay slips and education certificates. I sent my pay slips original and education certificates attested by corresponding institutes with sealed envelop. In US many institutes do not charge for notarization like Banks.

Yes, you can apply and the choice of your visa office must be Buffalo not New York office, because any other visa office in the USA does not accept the permanent residence applications directly from the applicants, they only accept the temporary residence applications directly from the applicants on those offices and the permanent residence applications transfered from Buffalo.

The second point, you only have to show them that you have been admitted a visa to the united states for at least one year, it does not mean that you have to spend one year at first and then apply. If your visa is a one year visa, you can apply as soon as you enter the united states.

Do not forget that your application must be sent at first to the CIO department in Canada "Sydney Nova Scotia", and in the space provided for the question asking about the visa office required for the processing of your application, write Buffalo, U.S.A

If they approve you, you will be instructed to send your full application to the Buffalo visa office.
