Hi. Just received an email stating I didn't meet the qualification. I missed it by 2 points. Here's the error though:

"You were assigned 17 points for 2 but less than 3 years work experience. The point assignment is based upon evidence of work experience as a Licensed Vocational Nurse with ****** from October 2009 to date of application (02 Nov 2011). As you did not provide a four digit NOC code as required by Section 80(5) of the Regulations for your work experience with ****** from November 2001 to June 2007, I did not assess these documents for work experience, as per Section 80(6) of the Regulations."

On my application, I put there October of 2008 AND NOT 2009, which should give me at least 3 years of work experience. Here are my questions:

!) What is my recourse now? Can I appeal due to their error?
2) Say they grant me the 3 years work experience, will that be enough to give me additional 2 points?
3) WIll I be getting a refund?

PLS PLS PLS any help is appreicated


EDITED: After reviewing my file/copies, it seems that my work made an error and put 2009 instead of 2008. I already spoke to the HR manager and he's willing to cooperate with me regarding their error. They said they're willing to send a notarized letter regarding their error. Also, I'll include my W-2 (tax form) stating that indeed I started working there October of 2008.

Is my situation even salvageable? Will these suffice for them to review my application?

Nope, your application is refused. I think that your lesson learned is that you have to read what is submitted and go over it with a fine tooth comb. CHC will not make guesses or assumptions.

So theres no appeal that I can do? :( Will I be getting the application fee back? Can a help of an immigration lawyer help?

Indeed. Very sorry to hear about your rejection - it's unfortunate but if your work makes an error on the work experience documents this is not CIC's fault, it is your responsibility to check all the documents before posting to CIC.

CIC will not consider any new documentation once a decision is made, and the only recourse is if CIC have made an error based on the documents already in their possession. Clearly this is not the case.

As for a refund, you should receive a full refund of the processing fees if, and only if, your application had not gone IN PROCESS. It sounds like your application failed at the eligibility review stage, and therefore hopefully you should get a full refund, but this is likely to take several months.

my friend got NER letter just today but it did not mention if CIC is going to return her bank draft along with her documents... what is usually the case when an applicant receives an NER at the CIC level, do they automatically send refund if bd has been encashed or does the applicant need to write to ask for reimbursement.

also, if application was denied due to lack of points and the applicant has not declared that she is currently studying for masteral degree as she is just about to graduate this march and can get transcripts, diplomas by mid April... will she be able to resend her application with this new additional education? Her NOC is still just in the 150s so if she can send additional education/degree, she may be able to catch up with cap.

one of my friend applied with incomplete work experience showing she was continuing job and she will acquire experience by the time application is reviewed. but she was denied processing.

I think they will send back the dd with application pack. You have to mail them asking for your application pack. And ya she should apply again with her completed degree an completed 4 yrs work experience. Any uncompleted degree or work exp will lead to declining again.

They will reply your application pack with regular mail still you should contact them asking for return arrangement. Good luck.

At the time of filling up the application, did you make the copies of your filled application form?

If you mentioned your experience starting from October 2008 then it's an error from visa officer side, you need to be sure what you wrote in the application form. If its an error from there side you can always write to the visa office with all the facts to reconsider the decision.

Could you also gives us more details like when did you filled your application and what was the stage of your application , when it get rejected?

Firstly, thanks for all the feedback guys. Here's my timeline so far:

Sent/mailed:
October 26, 2011

Received:
November 2, 2011

Bank Account debited
January 9, 2012

Rejection:
February 9, 2012

I checked online for my status and it is already "in process", so i am figuring there goes my $1100 application fee. My main concern really is will I be getting my documents back. It took me months and months to gather all those and to start all over again is unthinkable. Also, is there a grace period before I can apply again or i can just re-apply outright?
 
That means your application got rejected at CIO...? If not then did you receive positive eligibility review from CIO, means any letter from CIO stating that your application has been assessed positively
