hi! I’m posting this on behalf of my sister.

She entered Canada in 2012 on a study permit and a temporary resident permit (trp) because we both hold passports that aren’t recognised by Canada. In 2016 when she had to renew her TRP (which was on a 3 year period), the application was rejected and she was issued a removal order which she complied with. at the time she had a valid visa in the UAE because our family lived there so she moved there and successfully reapplied to continue her studies here.

Fast forward to 2018, my sister had to extend her study permit because she had extra classes to take. Her current student permit expired Nov 2018 and because her classes ended in dec (graduation) she applied for an extension (including a TRP extension because it was expiring too). Because she’s a TRP holder, all extension applications taking longer time than usual study permit extensions so she finally heard back from the visa office April 17 2019 and it was a rejection asking her to leave the country immediately. She’s currently looking for options for reentry or staying in canada while sorting out her affairs so she leave the country by the end of May and comply with the rejection letter.

**the other reason she also wanted an extension on her SP and TRP is so she can apply for a work permit .. she doesn’t qualify for a PGWP because she had to take a break in her studies because of the rejection she received in 2016.

**could she do a restoration? the reason her last SP expired in Nov 2018 was because they thought she finished her classes in August but she had to take an extra semester so she should have been able to apply for a SP extension into March 2019 which would give her enough time to apply for WP

Getting an LMIA and a WP is often a 6 month process if you find an employer. Most are not interested in paying for an LMIA and waiting a long time without any guarantees. She should have applied earlier to extend her TRP. Given her studies have been drawn out over 7 years she was only likely given a TRP for the shortest amount of time to finish her degree. She is quite lucky to have been given another chance to complete her studies. Others have been denied.

Unfortunately I don't see how she can extend her trp until she can get a WP and should plan on leaving Canada within 30 days of receiving the letter. She has been out of status since November and wouldn't qualify for restoration.
