Ya, it's going to depend on when she applied. If she applied August 2012 or September 2012, then most likely evaluation has not started yet. Was it by FA01772 or SL01732?

Also, hooman2012, did you PER yet for your new application? When was it received by the CIO?

Hi all,

I was wondering if you know anybody here who's got rejected because of the wording of work experience letter! I just got rejected as the officer believes that my job duties do not match the NOC one that I selected. I think it is not word by word the same statement but they do match if you read thoroughly and compare more carefully!
Have you seen anybody take it to the federal court? what are the chances? has anyone been successful without an immigration lawyer?

They just took the money, which means that every thing is on schedule and I am not gonna rejected by sidney.
Also my previous application is still in process and I manage to update my reference letters AGAIN. I wont let them reject me so easy.

I know this because my friend applied August 2012, we checked his GCMS after he got document request, and evaluation has not started yet. They (CPP-Ottawa, RK6165) only wrote something like 'PhD info requested' or something like that (and yes, he's Iranian in case you're wondering; nobody else seems to get requested information about their study).

I'm sorry about your rejection :(

And yes, the majority of rejections here were precisely due to this reason. We have maybe 10 - 15 rejections because of that reason in this forum alone, and only two seem to have 'successfully' overturned 'Decision Made'. But these two (aidina and hooman2012) sent out additional supplemental letters to Ottawa after their applications but before assessment, and OP6B dictates they have to consider these letters if they were sent before assessment.

If you are serious about immigrating to Canada, while waiting for their notoriously slow response to appeal email, it is probably not a bad idea to also start preparing for new application. Now you know what they did not like about your old application and you can try addressing them with your new application.
 
Thank you for your response. Have you seen anybody who's appealed and came out successful? what are the chances? do you suggest I hire a lawyer for appeal or it is doable without a lawyer?

I emailed my updated work experience letter to them today. The updated letter includes the Assist university professor in RESEARCH ACTIVITIES and my publications .
At least I can tell them that I have emailed them the updated work experience letter before getting the refusal letter.

I was just talking to one of them, she just incldued TA and RA and RA did not even have the word "Assist". She just got her document request.
I am angry, WTF???!!!!!!

It is not only about the letter, is about other evidences. You guys have to provide documents for everything!!! As many as you can.

Have all the 10-15 people appealed through federal court and got no favorable response?

I just read that I cannot add any documents to the application for appeal in court. I just want them to look at it and that is why I am wondering weather these 10-15 people actually went to court and the court believed that the officer has made no mistake!

The problem is that reapplying would take at least 3 months for me to gather the documents again, and probably another year to hear back again and I don't even know why they rejected my letter so that I fix the problem in the second one...I am thinking maybe I should have assisted my previous employer in writing the letter by copy and pasting from the NOC website which seems rather idiotic! Some very general duties are mentioned in the NOC website, my letter is more customized to my previous job. Ex. where there is "Design components, machinery, powerplants..." in NOC, mine says "Design EPS parts." I mean I couldn't have done all in one job, could I?!!! the other duties look like this one in my letter...

And I notice that the thread is missing PER. PER is positive eligibility determination of your application to be processed further. It is issued by the CIO once they acknowledge that you are eligible to apply for PR under the appropriate FSW stream (FSW1, FSW2, or FSW3).

Basically, PER tells you that you are eligible to apply for PR, but not necessarily for the PR status itself. Visa Office will determine your eligibility for the status, though depending on where you live, being eligible to apply for PR already entitles you to some benefits (for example, in Ontario, having PER email clears your eligibility for the provincial health coverage).
