The fees will be refunded if they haven't started processing it. I think they haven't started yet as you applied on November, as I filled my application in Feb. 2012 and they started processing March 2013, as you may know, I got the rejection in March also!

The second application was delivered to CIO few mins ago.

Yes sure, the 1,100 is to be considered. I wait to get the PER for the second application and make the decision at that moment, to be on the safe side.

I suggest you order CAIPS or GCMS notes prior to making a decision. These notes may give you an indication how they awarded you the points. Let's say you get 75, then it's a safe bet it will be accepted. If it's 67, it's a bit risky as they may later revise the points to your disadvantage.

The thing is, we need to wait until Ottawa officer does the assessment. Sydney usually does some preliminary eligibility assessment, but as we have seen over the past several months, many rejections were initiated at the Ottawa level, and these rejections were mostly due to Ottawa not accepting job descriptions, therefore, leading to applicants not even meeting the minimum requirement of one year of continuous work experience. And it will take many months usually before Ottawa starts assessing transferred applications from Sydney, so ordering GCMS before this assessment is made may not give any clear picture as to how the final evaluation is conducted.

If they start processing on it in CIO ( eligibility assessment ) , you won't get your money.
One time I applied under FSW and got 66 points in CIO and rejected and did not get money back.
 
Finally sent my passport today! hahah about a month after the request! You should not follow my example!
 
my strong recommendation to you would be to let both applications run. Don't worry too much about refund of $550. If your first application goes through, you will have your PR much earlier, otherwise, you have second application anyways. Just my thought,

I have a good news,
After I complain about my rejection, they did not respond my email since April 8th, But again, my status has been changed to In Process from Decision has been made.

Wow, this is big. Did the 'Decision Made' line on your eCas disappear as well? So it only says 'We started processing your application ...'? But maybe this could be your new application rather than the old one? Why don't you apply for GCMS notes using your old file number? It should give shed some light on what's going on.

No, I am sure this is not new application because my new application just arrived there yesterday they did not even took the money.
But yes there is decision has been made line. But I asked those who got rejected, their status in NOT in process.
Also I have asked about this, I have been told that this is a list, that ye will add to this list. So far,
1) They started processing my application on April 8th,
2)The decision has been made (my rejection),
And my status WAS Decision made. But now it is changed to In process and I have been told that they will add to this list probably number 3. I asked multiple people who got rejected before me, their status is not In process,

AND I never recevied any email from ottawa yet.

Hm...That's new. I haven't heard anything from them since I sent the inquiry on March 22, 2013. I sent another email last Friday, but still nothing so far. My ecas is still "Decision Made". This is really annoying that they just ignored my email...Although I didn't expect them to overturn their final decision...

Anyways, hope this is really a good news and keep us posted.
