I am about to sponsor my US husband from here in the US (I am here working 8 years now, got my green card in 2007). Just realized that the 2 state police certificates expired earlier this month (i.e. were obtained +3 months ago) but if we apply and wait to get new ones, then the FBI cert will expire in the meantime, and that took FOREVER to get!! So are we in a mess, or should we go ahead and file now and hope somehow the state certs will get forgiven? We are otherwise super-straightforward married young professional couple with a dual citizen baby. I am Canadian born and educated and all my family are in Canada.
 
To answer my own question, it looks like we don't need to include the (expired) State certificates, so we should be all set with the still-current FBI certificate. (Also, FYI, the FBI no longer sends back the fingerprint card, which they state on the response letter.)

Do I need to provide a police certificate when applying for permanent residence?
Yes. Applicants should provide a Federal Bureau of Investigation (FBI) certificate with fingerprints. State certificates may also be requested. The Visa Office will advise you if state certificates are required in your case.

From Checklist:
POLICE CERTIFICATES AND CLEARANCES
Police certificates or clearances from each country in which you and every one in your family aged 18 years or over have resided six months or more since reaching 18 years of age. You must attach the original police document(s).
 
If you already have them, I'd go ahead and send in the state certificates. It says they'll ask for them if they need them, but if they do, it's likely to delay your file while they wait for a response from you. If you send in the expired ones, I think there's an even better chance that they won't ask for any.
 
I agree with BeShoo - send them as long as you have them. Also, if you find yourselves in the position of having to apply again for the FBI clearance, you can expedite receipt by writing "Canadian Immigration" and a "Due By:" date on the outside of the mailing envelope. I did that three times, with a six weeks due date request, and received all three clearances back within a month.

i didthe same thing but never got mines that quick! by the way... i recently called the cic and asked them they said... they cant gurantee but from experience if you do not have a record they most likely wont make u do it again... if you do then morelikely they will but doesnt gurantee they wont period
