its took only 3 months will see what happen in my case

Congratulations on winning your appeal. We are trying to get ADR on the basis that the visa officer(s) lied. Even though we appealed in January, our lawyer didn't get our bluebook until July 12th. She said when she called the ADR people before we received the bluebook, the woman she was talking to told her our interview was conducted in French and how could we communicate if I didn't speak French and he didn't speak English. My husband speaks perfect English and the interview was conducted in English, so I don't know if the visa office is trying to pull something else or if the ADR woman just looked up the wrong file. My lawyer said to me "Why would she tell me it was conducted in Fench and that he doesn't speak English? That's bizarre." The lawyer told us there was nothing new in the bluebook other than what I gave her already. She said if the interview was recorded then we shouldn't have to do anything else for ADR.
Wow I cant believe the lies these Visa officers tell and they get away with it!!

What is my best option since I had applied 2 time already the lost in full hearing, I have baby , they did not ask for DNA and dismissed the position point saying there was no DNA of the baby as evidence. Should I go to federal or reapply
Do you mean DNA was the only reason to reject your appeal or was there any other reason as well?, mine has too a baby should i do it in advance?

I am now reapplying again after 1 year of appeal dismissed. With 2 child born of the marriage. What are my chances to prove marriage is genius now I have 2nd child and been married for 6.5 years

I am very sad to hear that you have kids together, married for over 6 years and still get denied..:((( I don’t know how can it be possible! So hope this time you get all the necessary evidence to prove that your marriage is real! God bless!

what was the reason for the first time appeal dismissed?

Congratulations for all affected by section 117(9) amended like this
    • (d) subject to subsection (10), the sponsor previously made an application for permanent residence and became a permanent resident and, at the time of that application, the foreign national was a non-accompanying family member of the sponsor and was not examined.
  • Marginal note:Exception

    (10) Subject to subsection (11), paragraph (9)(d) does not apply in respect of a foreign national referred to in that paragraph who was not examined because an officer determined that they were not required by the Act or the former Act, as applicable, to be examined.

  • Marginal note:Application of par. (9)(d)

    (11) Paragraph (9)(d) applies in respect of a foreign national referred to in subsection (10) if an officer determines that, at the time of the application referred to in that paragraph,
    • (a) the sponsor was informed that the foreign national could be examined and the sponsor was able to make the foreign national available for examination but did not do so or the foreign national did not appear for examination; or

    • (b) the foreign national was the sponsor’s spouse, was living separate and apart from the sponsor and was not examined.
  • Definition of former Act

    (12) In subsection (10), former Act has the same meaning as in section 187 of the Act

Wow I cant believe the lies these Visa officers tell and they get away with it!!
I still don't know whether the woman from ADR looked up the wrong file or not because my lawyer hasn't been able to talk to her because she has been on vacation. I think she will be back next week, hopefully we will get some questions answered then. She is the one supposedly handling our ADR file.

It took you 2 years after won appeal. This is crazy. But I think passport only takes about 2 to 3 weeks, it wont be too long. HongKong is soooo slow.
