Thanks for posting these sample questions..it is a great help. After filing the notice of appeal last November 2012,my partner got a Notice to Appear for an ADR Conference on July 9, 2013 in Toronto.I am really praying for a positive outcome on our appeal. Goodluck to all of us...Godspeed.s:)

It says on the refusal letter that they are sending appeal provisions to my wife in Canada... Does they send the appeal forms???
30 days is after the reciept of forms in Canada address or after reciept of the refusal letter in India address???

Also my wife is from Vancouver so is it so that the wait times in vancouver are lower???

the notes were sent to me automatically 3 months after I filed the appeal. There should be Appeal form with rejection letter but sometimes they dont (you can download it) Your question about the 30 days is interesting. Not sure the answer but I would assume, once its received by sponsor in Canada.....please confirm this ! Yes, wait times in Vancouver are reasonable. (in Toronto-over 2 years) Best of luck ! Stay strong....most appeals are allowed !

Thanks Gsize.. I have a question if we don't get an ADR hearing do we have an option for not going for a full hearing & rather re-apply??
Also Is it possible to appeal for an ADR without a lawyer??

the answer would be no to that...the date on the refusal letter would count up to 30 days...so the option he or she has is to down load the appeal form and fill it out make sure to attach a copy of the refusal letter which the applicant recieved and once the sponsor recieve the refusal letter he or she can send in a copy of sponsor's refusal letter to the iad office ..good luck hope this helps..

yes, Im pretty sure you can re-apply but I think its best to file Appeal (especially if wait times for your city are short) You dont need a lawyer/immigration consultant however, I highly suggest you find one. Many will give you free consultations. They will all tell you about their high success rates and gladly take your money. You need to go with your gut feeling. Stay positive and strong and most important.....never give up hope ! :D
 
Hello everyone, i would like to know from members if i can file an appeal without a refusal letter from the visa office. I saw that the officer has refused my wife's application based on the fact that she wasn't satisfy with my wife's identity. I waited since January without recieving any letter from them and i can't wait no more cos i need to save myself sometime. I even sent them few emails addressing my concerns but no reply from them and now i don't know if i can use the GMCS note to file an appeal? Thanks in advance
 
Has anyone ever been refused without an interview? I'm starting to wonder if my VO thinks we married under the wrong Indian act...

There are loopholes for abusive relationships/and death of sponsor. I would imagine in the event of a death it would be thoroughly investigated to assure the cause of death was um....natural.

bcoz we believe that we dont need a lawyer or consultant but, its better if we can get any guide from somebody.

I was thinking of it bcoz it should be done as there are lot of fake couples entering Canada & then be separated after its done. bcoz of this reason its very hard for the genuine couple to be united lovingly in Canada & wasting there precious life time by waiting for the PR. it is very good & i like it.

if they be separated before the time, should not only PR is cancelled, they should be deported. then it'll be easy for the genuine couples to enter to Canada easily. We are suffering like this bcoz of the fake couples bullshits.
