Hello everyone....
Today we got refusal letter for Conjugal application, stating that we did not provide legal proof regarding marriage barrier ( which we think is absolutely not true in our case ). I live in Toronto and our VO is Ankara, Ive read so much about appeal but im so comfused.... Can someone briefly explain how does the whole process work and also the processing time to get this nightmare done? Many many many thanks
 
first thing you need to do is file your Appeal. You have 30 days. It then becomes a waiting game. I can tell you that I had to wait 2 years to get a Hearing date in Toronto. If you get an ADR, it will be around 6 months. Keep in mind, timelines change. Hopefully, it will be shorter time for you. (I am in Toronto while my partner is in Mexico)

I can tell you that most Appeals are allowed. Waiting, is the hardest part !

Thanks dear. How can I make sure Ill get ADR and not Hearing ? Is there a way? Or happens by chance?
 
My understanding was (and is) the ADR is granted when there are one or two issues that they feel can be dealt with, otherwise it goes to full Hearing. It is not up to us.

You can definitely talk to people at the Immigration Appeal Board and tell them you want an ADR and why you think it is a good choice, but ultimately if they feel there are a lot of problems they will go with a full hearing. Try talking to them, though. I found that the agents at the IAD were willing to talk to me about my case and were more helpful than CIC. (Though I went through the Vancouver office.)

now have to appeal how much will the lawyer cost and the time of this waiting game....the reason they refused me because of odsp and that i cant support him when he come down to canada...iam from toronto and looking for a lawyer and how much it will cost for the whole process....please share some info that i can be prepared and also how long it will take to get the refusal letter thanks in advance for the replies

quick question, u said about odsp, is the reason of the refusal its because u owe tax from the revenue??? just want to make sure what was the reason on the refusal, if u owe some payment on tax for the revenue ,though u have arrangement will it still be the grounds of refusal???

no i didn't owe no money to revenue....but at the interview she said she is refusing cause iam odsp and that i wont be able to support him once he gets to canada and he will end up going on welfare....
 
It is so hard when a Visa Officer try to tell you that your marriage is not genuine after you provide them with all that they have requested for the interview. How in hell would a man be on my life insurance policy and my OMERS Pension if he is not my husband? these people must be out of their minds to think that way. We are in our late forties and early fifties and this is really crazy. How could you be away from your spouse for such a long time? I am looking at some crazy time that people have been waiting on this forum. What a shame!

:o :'( :( >:( :-[ Hi everyone my hubby's interview was January 07th 2013 and he was denied his visa January 08th by means of a phone call at his house.I have an IMM Consul that is waiting for hubby's signed form to receive the CAIPS notes and she is also still waiting for the denial letter so we can appeal. Hopefully we can get this resolved with an ADR. We have 8 1/2 years together and more than enough proofs that supported our sponsorship app. We are shocked, devastated to our very core and very, very sad. We cannot believe this... Anyone know how long it takes to receive a denial letter? Will hubby receive a denial letter as well? :'(

April will be 4 years for me. He will be REprocessed next month....please pray for us

I need your help and advices,please...

I am from the Philippines,my partner and i are been together for 4 years now,getting 5 years as met each other 2008. He visited me twice, first visit 2009 and second visit 2011.During his second visit we went to Vietnam and Malaysia.

We applied under Family Class Conjugal Partner- Same sex partner..our application was received November 2011 and last November 6, 2012 we got a refusal letter saying that the VO was not satisfied that we are in conjugal relationship, the VO thought that he is satisfied that there appears to be a relationship between me and my partner/sponsor but our relationship appears to be that of boyfriends and does not appear to be marriage-like. That the documentation we have provided do not show a committed,interdependent relationship.Upon the application we submitted Western Union receipt as proof of his remittances,his plane tickets...bunch of emails..photos..letters from friends,family and relatives proving that we are in a conjugal relationship..

Around June 2012 we got a letter from Canadian Embassy in Manila, Philippines that they need additional documentations that will support our application. My partner provided them his Last Will, Insurance naming me as his beneficiary, joint credit account which we got all from Canada...but unfortunately last November 6, 2012 we got refused and it was said that our efforts to combine our affairs by providing those documents like the Will etc. do not appear to be a prior established co-mingling of financial affairs,that's basically the reason of their refusal.

We did apply for an appeal and we submitted it to IAD in Toronto..i have this question and i hope i can get your opinion on this...

If one loses the appeal,can he reapply and start the application process over from the beginning?If not, would it make more sense to drop the appeal and restart the process from the beginning while providing the proper documentation and evidence that was lacking in the first attempt?
