All Set to Apply under CEC - Need some Guidance..!!

Hi All,

My name is Gautham, I have completed my PG Diploma 1 yr course in canada. I have been employed as a contractor in a software firm as Test Engineer.

I have completed my 12 months in this company with 40 hrs a week. I have two questions that I need your valuable advice from you folks.

- As i mentioned i am working as a contractor, my concern is that the company that i work is a client say Company A but my monthly Parole/T4 are given by other company that hired me (Company B).

I have asked a letter of reference from both of them and they have agreed to give it. Is it necessary that i submit both the Letters to CIC with my application.

- My second question is my designation is Test Engineer title comes under NOC 2173. But my job description and responsibilties match with NOC 2283. What should I use to apply under.

Please help me out with this.

I understand where you're coming from.
Submitting employee certificate from the company that hired you ( and who gives the T4 etc.) should suffice. You dont need emp. certi. from the client of your company. However, if you have emp. certi. from both, no harm in submitting both. Go Ahead!

NOC code is a tricky thing. Take extra care in determining that.
The job description and responsibilities are what should matter more. Designations can change with companies. So, go for the NOC Code that matches all the responsibilities as given in hrsdc.ca.

Thank You :) that clears the air for me.

The other thing is my contract will be ending soon by the time my file reaches cic . Will it matter that i will be jobless till i find another or will it not matter to them as i have completed the requirements of my work experience of 1 year. I want to drop my file as the rules are going to change by next Jan 2015.Please Advice

you dont have to worry about being jobless, what matters is have u completed 1 year of skilled employment in approved list of noc codes

CEC works on a Pass/Fail process. The moment you pass CIC's requirement of >1yr of work exp.in Canada, you dont need to bother about your application.
However, stay transparent to CIC about any change/updation in your work/personal status from what is specified in your application.

Questions related to NOC are the most common for PR applicants :)

The rule of the thumb is to use a NOC whose duties match closely to what you actually have been doing and what will be mentioned on your reference letter. The letter from the Canadian client is more important than a letter from another country.

I'm sorry to revive this thread, but after searching and reading a few thread in this forum, I found out that contractor = self-employed = not eligible for CEC. So, is he eligible? If so, how?

He's employed on a fixed contract (contractual employee), hence is eligible. The presence of a T4 confirms this.
If the relationship had been as an Independent Contractor, then that would not have been eligible. In this case, the contractor invoices the company and remits GST/HST to the government.

I believe he would need a letter from the comany he is working at as well stating the job description and NOC code.. the thirs party through which he is hired will not be providing that detail.. same happened to my friend who sent in only letter from the company who had contracted her and CIC came back asking for a letter from company she is working at including her JD and NOC code..

i used same letters and i guess he would need those too since we have to provide CIC with our job description from the company we r working at.. the company who has contracted us cannot provide that detail.
