What happens to H1B after you move to Canada ?

after getting Canada PR and moving to canada, would i be able to extend my H1B? I assume NO because i am not working for a US client, hence there is no SOW etc to prove the need for extension. pls chime in
Scenario 1: lets say, my H1B expires during my long stay in Canada, and now I want to come back to US on H1B. would i have to go through lottery again or would I be cap-exempt ?

Scenario 2: i extend my H1B for 3 years before moving to canada. (Yey) lets say till 2020. now, I move to canada and stay there for 2 years. would i be able to come back on same H1B at the end of 2019 before my H1B expires? has anybody wondered or has experience?
You can always file for a H-1B extension provided your cumulative stay physically in the U.S does not exceed the maximum period of 6 years.

For your scenario #1, During your long stay in Canada, if your stamped H-1B expires, its not a problem. You can always extend it if you haven't exhausted your 6 years. In that case, you would be cap exempt.

For scenario #2, yes you can always come using that H-1B which is having a pending validity in your passport. However, you may be asked a lot of questions at the port of entry.

Can someone please help regarding my FSW eligibility and my Years of Work Experience.

----------------------------------------------------------------------------------------------------------------------
1) Been in the US since last 7 years

----------------------------------------------------------------------------------------------------------------------
2) Masters Degree in Computer Science, USA (3 Years)
-- Teaching Assistant (Paid + 20 hrs/week) for the 6 semesters -- [NOC: 4012]
-- 1st Summer: Research Assistant (Paid + 40 hrs/week) -- [NOC: 4012]
-- 2nd Summer: Summer Internship at a Software Company (Paid + 40 hrs/week)

***************************
Question 1) Do I full-fill the minimum FSW Eligibility Criteria of having at least 1 Year of FULL-TIME + PAID + CONTINUOUS Work Experience ?

Question 2)
Do I calculate this work experience as

a) [#TA Weeks * (20 hrs/week) / (30 hrs/week)] + [#RA Weeks * (40 hrs/week) / (30 hrs/week)] = FTE #Weeks of TA+RA Work Exp. ?

OR

b) [15 hrs/week * #TA weeks] + [30 hrs/week * #RA Weeks] .. (to see if this equals 1560 hrs) ==> to have 1 Year of Full Time TA+RA Work Exp. ?

One Main Question :
I have been a MS Grad for at least 2 years, during which I worked CONTINUOUSLY as TA/RA (Aug 2010 - May 2012)
==> Fall 2010 (TA, 20 hrs/week) + Spring 2011 (TA, 20 hrs/week) + Summer 2011 (RA, 40 hrs/week) + Fall 2011 (TA, 20 hrs/week) + Spring 2012 (TA, 20 hrs/week)
==> Even though academic years are not 52 weeks ==> Wont these 2 academic years of continuous work qualify me for at least 1 YEAR OF CONTINUOUS + PAID + FULL-TIME WORK EXP ?

Due to Summer Internship in Software Company in Summer 2012 (NOC different from NOC-4012) ==> leads to discontinuity, otherwise: was (TA, 20 hrs/week) for Fall 2012 & Spring 2013.

***************************

----------------------------------------------------------------------------------------------------------------------
3) Working on Contract Projects in IT (USA)

A) Company A: Oct 2013 -- May 2015 .. (OPT + H1B)

-- Oct 2013 - July 2014 ==> Paid
-- Aug 2014 -- Sep 2014 ==> NO PAY .. (transition between project + on OPT-EAD)
-- Sep 2014 - May 2015 ==> Paid

Switch from Company A to B (June & July) -- No Pay:

B) Company B: July 2015 --Jan 2017 .. (H1B)

-- Aug 2015 -- March 2016 ==> Paid
-- April 2016 ==> Not Paid
-- May 2016 -- Feb 2017 ==> Paid

***************************
Question) Do I full-fill the minimum FSW Eligibility Criteria of having at least 1 Year of FULL-TIME + PAID + CONTINUOUS Work Experience ?

***************************

----------------------------------------------------------------------------------------------------------------------
Question) All over, AM I ELIGIBLE FOR FSW ?
Question) If so, How many Total Years of Work Experience can I get from my Experience ?

----------------------------------------------------------------------------------------------------------------------
Please suggest .. Thanks ..

I had CPC-CTD-Ottawa@cic.gc.ca asking for the change of Visa processing office for my myself and my wife. I had asked them to change mine from Ottawa to New York and Ottawa to New Delhi for my wife. I received 2 PDF documents with 3 mins interval in the IRCC application account messages. Both are addressed to me mentioning my name and my UCI and application number. One asks me to submit my passport and spouse passport to New Delhi visa centre via VFS and the other letter asks me to submit our passports to New York office. I am super confused now. The letter mentioning New Delhi should have clearly mentioned my wife's details but it is addressed to me. I am confused now what to do.

Looking forward for suggestion.
Thanks

Guys - i am currently in US. I have question about WES transcripts. I added my MS in USA school and the option suggested is doable for me. I can request my school in US to send transcripts to me or WES. But i am also trying to evaluate my Btech education in India.

For my B.Tech evaluation the two options suggested for me are not possible i think. Option 1 - is to request the board that issued the certificate to send document to WES. IF i send a request to university in Hyderabad India, i dont think anyone will care to send documents to WES. Some one has to physically go there and make it happen. i cannot go to India at this point.
The second option is to request the university in India to send document to me which has the same challenges as Option1.
Based on my experience 15 years back, someone has to go personally and get these transcripts in the format WES wants only then University people will sign and seal.
I am just trying to understand how other people who are in US dealt with this situation.

Thanks for all the help.

@buddy2434: Not Necessary to evaluate your B.Tech if you have a Masters. Just evaluate your Masters Degree via WES.

I suggest to evaluate all education credentials!! Yes it is ok to just evaluate Masters
Never know how it might be handy to evaluate both bachelors and masters especially if u have studied in two different specialisations

My 2 cents

@Troy2245: My B.Tech is in IT and Masters in Computer Science. What do you suggest I do ? Evaluate just Masters or both ?

no need to do both.

Doing both is only useful if your degrees are from countries whose education certificates often cannot be easily and smoothly converted into the Canadian ones.
  • For instance, a Master in an Indian university sometimes gets downgraded for some reasons. Thus, a lot of people suggest evaluating both your bachelor and master degrees for safety: two bachelor degrees give more points in the CRS system than just one if downgrading really happens.
This kind of downgrading seems to happen a lot upon degrees from developing nations for some reasons. Since your master is from a U.S. institution, don't bother with that.

Can veteran members here pls confirm if staying in Windsor, Canada and travelling for work every day to US will allow to meet PR residency and citizenship residency? Is this something that anyone has asked CIC directly?

Also, did anyone do a lot of soft landings before finally moving and would those stays (like in hotels) count?
I haven't landed yet but I have realized that any experience other than Canadian is not considered until it's exceptionally very high profile.

Does not seem to be true, based on some first-hand experience of me.

Maybe it is true with some limitations. Ergo, your statement.
